My soon- to be wife (US citizen, petitioner) and I (beneficiary) are applying for adjustment of status after getting married while IM on the vwp and we were wondering when we are filling the forms, do we need to write her maiden name, or her married name? Her passport, birthcertificate etc have her maiden name.

You can use either but stick to it throughout the whole application. The name you choose is the one that will be on her GC

Oh then she should use her maiden name if she hasn't changed it yet on her social security card and ID's

I think that it really depends if she wants to change her last name or keep it maiden. I think you should be fine both ways since the marriage certificate lists her maiden name and also lets her use married name

Like on the i-130, they ask for her maiden name too, so I guess its not a big deal if we use her married name, but in the rest of the forms they dont ask about her maiden name, so we were kind of confused and didnt want to create confusion or get denied for using a different name from her birthcertificate and driving license, we are applying for the name change after getting married, but we have to send the package before we change her birth certificate and all that because I want to send the package before the 90 days

I know the confusion. Same if the issue is regarding a beneficiary.. some forms ask for a maiden name and some don't.. I was filling with G-325a forms and I think it was easier since they had all the biographical information about a particular person. I was a beneficiary with a changed name to married and I just put married name everywhere and maiden when asked to.

Personally I wouldn't worry about it too much.if you want to use her married name then do it and then change it everywhere so SSN, passport, ID.. you should be fine :)

I.e the biggest confusion I had was the medical form asking for a maiden name (has to match passport) and signature.. but it seemed odd to me to sign all the forms with married name and one form with maiden :) but I got advised to sign with married name and everything was fine

Also, I found this thread

So, if its fine, we will use her married name, and submit the marriage license with every copy needed of her birth certificate, and after we send the package we will get her social security number and all the rest of documents changed. This question might sound dumb, but, I got 2 last names, does she get one of them? or both? or does she get one, and I lose one, so we both only keep one of my last names? I always been kind of confused when it comes to that subject (damn spanish long names hah)

That sounds good!

and about the names I'm not sure if that's what you mean but maybe it's worth a read http://boards.weddingbee.com/topic/latino-last-names-and-changing-name-after-the-wedding-question/ :)

Thank you so much! So she is probably taking my first last name and I will keep both of my last names (as much as I hate how long my name is I dont want to have to change my birth certificates passports ids and all kind of stuff) so we both will share my first last name, thank you so much! I dont have more questions about this subject!

She should use the name that appears in her documents at the moment she applies. Because the only confusion would arrive when and if they are trying to match her documents with the name provided in the application/s.

So if she is planning to get married and change her name, she should first change her paperwork and then start the petition. The very few people I heard had an issue had changed their personal documents after they had started the petition. So while they were waiting on their case to be reviewed.

Therefore you simply make sure you go with go with the name provided in the  personal documents, and don't start changing your name in the middle of all.

Married name. You guys are already married so she should be able to use your last name now. :)

Good luck on the application!
