The rules for ead's are clear - they are only valid while ead is pending. Once she gets a denial get are automatically invalid. It's not something you get a letter about but it is just how it works. After that she would be working illegally.

Not really same story though as your friend came on a tourist visa and this other person came on a K1 and never married.

The cases are different. K1 doesn't have the same case as a tourist entrant, they are not similar cases. Had the OP entered on tourist visa she could "marry another usc" if she were to find a new partner. The OP will never have that option.

yeah I know.. bottom line is same thing just go back home and then just come back here if someone is willing to petition again... as per visit visa same thing if you over stay the only thing you can come back here if they give you a ban is if someone petition that person...

Her husband is petitioning her from inside the US. She doesn't need to go back home. It's not the same thing. 

A ban is only activated once she exits the country.

I don't know all I know she is re-appealing for GC that's all because I've seen with my eyes that she has two years EAD that's all I can tell you... and she is working here legally in two jobs...

Even still... the OP's friend isn't going to be able to apply for an EAD or any other immigration benefit right now because when she submits an application for that it's going to be discovered that she didn't get married on the K1, and chose to overstay illegally instead.

 

USCIS would find that out pretty easily and quickly.

 

 I don't know if she'd have a good shot at getting an EAD...
