Well it might not be fraud if they have a past. 3 yrs in a relationship i guess its a genuine. I dont know how to explain but it was a serious. The guy just been tempted by another woman.

If the guy just been tempted by another woman, then their story was not genuine. This guy is cheap and his feelings are cheap too.

What if she wait longer and marry her petitioner someday, would that will work?

This is pure visa fraud.  She has to go home.  The sooner the better because the longer she stays the longer her ban will be.

What to do if overstayed? Any way to be legal?

let her go back to the PH, then petition her to come back here... whatever the reason is that's the only way she can be legal to stay here when someone petition her again...

Excellent point. Not only that but what kind of woman wants to stay with a man that was "tempted' by another woman?

It seems that the girl, the OP is talking about, is more worry about getting a GC by going back to the same guy... Getting pregnant or finding another USC. Sorry but all smells fishy.

It says k1 visa have restrictions.  U can only apply new one after 2 yrs. Im sad for my friend.

yes as a friend it's sad for her, her love story didn't end well and now she has to go back home.

but it's better to follow the rules, don't commit any fraud.. She might regret her decision if she overstays.

don't worry, your friend will be fine.

This sounds like a fraud marriage. Do not do this.

Yes, I completely agree. I feel people like this make is very difficult for "real" couples who are in same the process. It sounds so desperate, would do anything to stay in the US, even try to get pregnant :o:o Wow, it's not a game, it's real people and real lives and you want to use a child to achieve this purpose.

I hope an immigration lawyer can help

Immigration lawyer will tell your friend what everyone has told you here.   There is no way for her to stay legally in the US at present.

I'm from the UK, hubby is from Michigan and is a retired US Army LTC.   We are currently stationed overseas.

Here is our immigration journey so far....

10.26.13 - Our wedding in Scotland

11.26.14 - Filed I-130 at US Consulate, Frankfurt (DCF)

11.18.14 - Returned to Scotland to renew our vows for our first wedding anniversary

01.08.15 - NOA2 received in snail mail, together with case number and Packet 3 instructions

02.15.15 - Submitted Packet 3

02.17.15 - Packet 4 received by email with instructions to schedule medical and interview

02.18.15 - Email authorisation received from Consulate to gain access to appointment calendar

03.03.15 - Medical

03.18.15 - Interview - Approved

03.21.15 - Visa in hand

06.10.15 - POE Chicago (final destination Detroit)

07.20.15 - Received SSN in mail

07.27.15 - Received 2 year green card in mail

The journey to ROC starts here...!

10.05.15 - Returned to Germany on government orders

05.25.17 - Mailed ROC package to California Service Centre

06.14.17 - Received NOA 1 (dated 05.30.17) in mail

09.05.18 - Received a second NOA (dated 08.11.18) in mail granting a further six months extension to green card due to 'processing delays'

11.26.18 - ROC - Approved

12.05.18 - Approval Notice I-797 received in mail

12.18.18 - 10 year green card received in mail

The journey to citizenship starts here...!

What everyone else is saying here...she overstayed, she's here illegally.

Just making the decision to "Marry another guy" or "Get pregnant" or "Pressuring the guy to marry her" isn't going to help her case at all, will be found out as fraud (and trust me, USCIS *will* find out, they are quite good at spotting fake marriages), and she will find herself in removal proceedings.

Plus, being pregnant (if that's her plan) doesn't automatically mean they will allow her to stay...infact it may make them move to deport her sooner to ensure her child isn't born on US soil.

If she doesn't want to make things worse on herself, she needs to leave the US and try to find another way to gain residency legally again.  The longer she stays here, the worse she is going to make it on herself when applying for any immigration benefit in the future.

I understand that you are upset, and I understand that your friend is upset....but she is going to get herself into much more trouble with the government than she can manage if she is planning to do this.
