Hi,

 

I am due for ROC in a few months and I have currently the following evidences:

 

1) 2016 Tax Return - Married filing jointly; My husband did not work in 2015 so he did not file for tax refund. He have mental disability that makes it hard for him to work a normal job. For 2017 tax return, I am not sure if it will come with the deadline of my ROC. My conditional GC will expire in March 8, 2018.

2) 2 Joint car loans and car titles

3) Car insurance

4) Health and dental insurance - My husband is dependent.

5) 401K - My husband is the beneficiary

6) 1 Joint savings account - We do not have checking account for this. We are saving for a house so we are just putting in money on this account. I am the one who usually puts money on this account as I am the only one working.

7) 1 Joint credit card - The reason why we do not have a joint checking account is because we have a joint credit card. All our purchases is coming through here.

8) 1 gas credit card - I am the primary holder and my husband is an authorized user. We have same credit card number with his name on his card and my name on my card.

9) Wills and Medical power of attorney - My husband and I will notarized these documents for both of us.

10) Pictures - We went to LA last year April to visit my relatives. We have boarding passes and pictures to prove. Also, we are going to the Philippines this year and we will save the boarding passes and will take tons of pictures.

11) Affidavit - I am still working on this one. Will my husband's grandmother, his best friend and church family friend sufficient enough to create an affidavit that we are married and living together since I got here in the US?

12) Bank statements of my account that shows I give my husband some money - Since my husband is not working, I am giving him some spending money every month. It will be shown on my personal bank account and his personal bank account statements. Can this be an evidence?

13) House status - We are currently living in my father-in-law's house. I give him money every month to help with house bill expenses. The money I give him differs every month depending on how much I can give.

 

These are the evidences that I can think of that I can provide for my ROC. Are these sufficient enough? Are there any thing I can add on these? I am currently gathering all the evidence early to be organized.

 

For reference, I am the non US citizen spouse and my husband is the US citizen and the one who petitioned for me.

Regarding #13...have your father in law write a letter stating how long the two of you have been living there, helping out with the bills, paying rent, etc.

 

Submit copies of any utility bills with both of your names on it.  USCIS *loves* utility bills for some reason.

 

You can also, if you are called for an interview, bring any holiday cards or letters received that was written to the both of you (this goes a long way in proving that OTHERS see your marriage as valid, too)

 

 

Personally, I think you have more than enough proof...but I would suggest taking care of #13 a bit more since that's the main proof that you physically reside together.

We do not have utility bills in our name. Since we are living with my father-in-law, all the utility bills are in his name. Our phone bills is under his too since it is cheaper due to group package deal. But I will see if I can leave on his package and have me and my husband's own phone bill.

 

For the house situation, I will ask my father-in-law to write a letter that we are living together and paying him rent. Though, the rent payment is not the same every month.

They won't care whether you are paying him the same amount of rent, or even if you are paying him rent at all.

They will only care that he validates that you live together in the same dwelling.

Do you and your husband pay for any club memberships together?  Like gym memberships, netflix, shopping discount clubs, that sort of thing?  Anything that would be billed in both of your names?

We have crunchyroll and hulu in our joint credit card. It will reflect in our joint credit card statement. Does it count?

Hulu counts as a bill...it's not a utility, but it's still a bill...see if you can print out some sort of statement from your Hulu account?

It might be going a bit overboard, but the way I look at it---anything you can produce helps your case.

The big ones that you already have are the wills and medical power of attorneys. Those are very important. The health and 401K are also good. Send statements from the bank account and credit cards that span the entire lenggght of your marriage, not just a few recent statements. I agree with Going Through--have your father-in-law verify that you both live in the same house. My guess is you will be fine. Good luck.

Hi,

 

I have a question. The bank statements we have starts from the month I moved here, March 2016 instead of the start of our marriage, Aug 2014. I came via CR1 and we do not have any financial co-mingling until I moved here. Will that be an issue?

You have a lot more evidence than we had. Anything that we didn't have I just explained why in a cover letter. So you should be able to address your bank statements issue with the cover letter. I do agree with the other posters about getting your father in law to make an affidavit about your living arrangements. Good luck, it looks like your well prepared!
