My husband is a LPR and petitioning for me. Our PD is on Feb 2017. And since USCIS has decided to use dates for filing chart in March 2018, we are wondering if we could file I485 package(with I765 and I131 and such). We have not yet recieved the I130 approval.

 

I'm currently working in the US legally. We are really confused on if we could file I 485 and have it pending.  We called USCIS multiple times an each time we got a different answer. People on the other side of the line sound like they have no knowledge of the chart B. But everyone in this forum seems to be more knowledgable than them..

 

We did see that on the visa bulletin site there's such lines "Applicants for immigrant visas who have a priority date earlier than the application date in the chart below may assemble and submit required documents to the Department of State’s National Visa Center, following receipt of notification from the National Visa Center containing detailed instructions. "

 

Is F2A category considered a visa? In our case, do we need to wait for NOA2 from NVC to file our I485 package?

Dec 19, 2016: F2A I-130 Priority Date

AOS with pending I-130 (F2A):

March 2, 2018: AOS Package PD (I-485, EAD, AP)

March 14, 2018: NOA1  / E-Notification // Physical Mail: March 20, 2018

March 17, 2018: Biometric Appt Notice received //  Appointment: April 6th

March 29 RFIE // April 11 USCIS received RFIE response

May 10, 2018: I-130 Approved  :D *But case sent to NVC*

July 11: INFOPASS Appt + Sent Additional Documents

July 20: Case Ready for Interview (Finally!)

August 14: Card being produced //  August 22: Combo Card in hand

Glad to have come across this thread as we are on the same boat. Waiting can be very frustrating at times. 

 

My wife's PD is April 27, 2017 at CSC and we are yet to receive approval notice.

Timeline

They haven't got around to 2017 yet, but close. Last official notification I got they were on November 2016 PD, although i have read on this forum that there are a few December 2016 PD receiving their approvals.

My PD is January 31, 2017. Hopefully they will reach us by next month.

Hi Guys,

 

This is my first post in this group and I need some suggestion.

 

1. I came to US in Feb 2017 on B2(Visitor) visa to visit my family. I often come to US for 6 months in US almost every year. My I-94 expiry date was Aug 2017. I was taken to secondary inspection at POE regarding my frequent visits.

 

2. I met my husband in May 2017. He was a Green card holder. We decided to get married and filed for my B2 extension and I-130 for Consular processing. Since then I am in US. I have not received any decision on my first extension so after 6 months I filed for my 2nd B2 visa extension so that I can stay in US. In the meantime my husband filed for his citizenship and today 04/06/2018, he becomes the citizen and I become his Immediate relative.

 

All the above processing was done by our attorney till date except my husband's citizenship process (which we had done ourselves)

 

Now here is the current situation.

 

1. I had filed my I-130 petition in F2A category. My PD is July 25, 2017. There is no NOA2 received yet.

2. Now I have become an immediate relative that means I don't have to wait for my date to be current and I can file AOS and packet IV.

 

I want to know where should I send my papers to upgrade my application. USCIS or directly to NVC?

I want to submit all my papers myself instead of going through an attorney as I already gave the hefty amount to him and there is an additional cost which is equivalent to the fees he is asking.

 

Please advise.

Hi! My husband is a green card holder who has field for citizenship already. I was on a J1 visa before and after we got married, He petitioned me on the 20th of August 2017 and we got the receipt date on the 22nd. Since then, nothing has moved. They have sent my case to California Service Center.  Would it be possible for me to file for work authorization permit with the application pending?

Congratulations!!! 

 

Forget about NVC, you will not able to leave the US if you file for Adjustment of Status (AOS). You have to notify USCIS for them to upgrade the petition to spouse of an USC.

 

To adjust status you have to send form I-485, it can be filled without the help of a lawyer. If you also want Employment Authorization, you can file form I-765 for free with I-485, and I-131 if you want to obtain Advance Parole, which you could use if you need to travel outside the US. You cannot travel outside the country with a pending I-485 unless you have Advance Parole. Your pending extension now has granted you Authorized Stay, and the pending I-485 would also grant you that unless it is rejected. Remember to include a copy of evidence of your husband's Naturalization, and you must send all that to USCIS Chicago Lockbox.

Good to see movement in December. Good Luck eith the RFE, I hope it is something easy, and soon after they receive the response, you should get approved, a few weeks at the most, Good Luck!!!
