You'll face scrutiny for adjusting from a tourist visa. I honestly don't see the benefit in doing that too - you won't have to wait for NVC but you will have to wait for AOS. Same thing. I read the wait time for work authorization is about 5 months.

Thank you so much for your feedback...this is positive news for me. I have one last question, if you don't mind. How can I tell when her PD is current? Are you talking about when the Visa Bulletin shows that her category (F2A) at that time the NVC has it as "C"?

Thanks for your feedback. I do appreciate your perspective. What is killing me is the waiting away from my wife (and children). My marriage is literally languishing because of this 2-3yr journey/separation. Living the two separate lives is very difficult on our marriage.

If your PD is current and your I130 is approved, I believe it’s better to go through NVC, one of my relative had same case and had to face 3 years bar from entering. Adjusting status on tourist visa is looked upon by the officials.

You are right! Purpose of tourist visa isn’t to visit and adjusting while on tourist Visa might have bars later, it’s better to do NVC

Yes C is current.   Otherwise PD is the NOA1 Date.

There are drawbacks including waiting 6 to 8 months currently for EAD/AP.    A majority of us here have waited for our spouses.  As a LPR you should have realized that there would be long times of seperation.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Thanks for the advise. I will indeed heed this advise and await counselor/NVC processing. The last thing we need is to have waited 2+ years to then run afoul at the finish line. That would be devastating.

I received a Welcome letter yesterday, to my great surprise. It's been 1 day short of 7 weeks since the petition's approval. Both me and my husband got the email. I didn't contact NVC in any way and I have no idea when did they received the petition. 

Now, I know most people have different experience. I suspect it was USCIS that fast tracked my petition to NVC because the approval happened past normal processing times. So no need for panic if you don't receive yours within the same timeframe. ☺️

They will not send ordinary mail?

They will only send you emails. NVC went paperless couple of years ago. They will only send mail to cases that didn't provide any emails for whatever reason.
