If AOS interview goes well...

Hello all, 

 

I have AOS interview soon in next week, which is great. 

 

But just to make sure that if AOS interview goes well, and got approved on the same day, I am aware that I shouldn't use my EAD card to show my employment eligibility

if I get hired by a new employer because when I am approved, I am no longer qualified to use EAD but wait for green card. 


My circumstance is that my new employer gives me new offer letter today and upon successful pass of drug test, I can start to work, which usually takes 2-3 days. 

Because if my AOS is approved, the new GC card will be taking a week to 2 weeks in order to be physically delivered, for which I am concerned that the new employer would not like this kind of delay in starting the employment, which can jeopardize the employment opportunities that I don't want to miss. 

 

Assuming AOS interview goes well and taking that into account, what options would you recommend?

 

1) If the IO approves the case at the spot, I will ask for I-551 stamp, explaining this circumstances? 

2) If the IO approves the case either at the spot or approves later at the same day, should I just visit USCIS infopass to get I-551 stamp? 

3) If the IO approves the case at the spot, can approval letter serve as proof of employment eligibility as green card holder? (as I am aware that many local USCIS does no longer stamp I-551)

 

 

If AOS interview DOES NOT go well, meaning USCIS needs to review the case further, then the question is can I still use EAD to prove the employment eligibility? 

 

Well as you might know, if I must choose whether it is professional employment opportunities or successful AOS approval, it would be AOS approval, meaning that I have to choose AOS approved at the expense of annoying new employer and potentially risking to lose the employment opportunities, which is not desirable, but I am aware that legal status is more important than just compensation from employers.

I'm not really sure why you would think you couldn't use your EAD to work before AOS, that's what the EAD is for. 

 

Use your EAD to secure the job and work until your receive your greencard.  After you receive it, you can update your employer records. 

 

Someone please correct me if I'm misinformed!

Timeline

Use your EAD until you get your GC in the mail. Because anyways the GC (if interview goes well) can take a few weeks to arrive. Good luck with your interview!

Yes before AOS, EAD is for  temporary work eligibility, but after AOS interview, it really depends on how the interview goes. 

I am aware that USCIS no longer takes away the interviewee's EAD/AP at the AOS interview, but as we all know it depends on case-by-case, so we don't have control if IO asks me to turn away EAD/AP. 

 

On the mean time, since my drug test will be completed by next week, and if IO takes away my EAD/AP, then I don't have proof to show employment eligibility until GC is physically delivered, during which the gap can jeoporidize the employment opportunities, which is why I am asking if anyone knows. 

 

Thanks for your comment, Hopefully I will do complete I-9 before AOS interview date so that my employment verification is completed, then

I was informed it is the moment that IO declares that my case is approved, I am qualified as Green Card, or Permanent Resident, meaning that I may no longer use EAD

 

But I will just try to finish completing I-9 before the date of AOS interview, which would be then the best shot
