Expedite prolongment / Lost

Hello,

 

On June 5th I submitted a request to expedite my case on the grounds of a medical emergency(my 18 month old son requires a time sensitive surgery on his genitalia that is not available in my spouse's home country). On June 6th I submitted the evidence requested by the USCIS via email and received an auto-response confirming receipt. On the phone I was told that decisions based on war or medical emergency are usually resolved within 5-10 days, but I should call back in two weeks If I hadn't heard anything. I called on the 22nd of June and spoke with an immigration officer. That officer said my request was still in process and to wait patiently. The officer asked If I wanted a "note put my on account" for other officers to see -- I said yes. After that phone call I received an email of no real substance(basically, just confirming I had called with no reference to the original request to expedite). On July 7th, after 30 days, I called again and spoke with an immigration officer who informed me there was an action on my case on July 3rd and that I was to wait until July 22nd for a decision. Perplexed, I pushed back and asked why, "Because you made a request on the 22nd...and a decision can take up to 30 days -- if you haven't heard anything call us back in August." I explained to the officer I only made one request to expedite, "Well, there are two" she responded. The officer that I spoke with was curt and unhelpful. She said I should email the Texas service center and wait for a response. So I did. I wrote up a brief summary, almost exactly like this one, and sent it off; this is what I received: 

 

Hello,

 

Expedite requests must be handled through the National Customer Service Center (NCSC) phone line at 1-800-375-5283.  You should receive a response within five (5) days from the responsible USCIS office.  The response will be sent to you via standard U.S. Mail Service and/or e-mail if you provide your e-mail address at the time of your call.

I am at my wits end, how can it possibly take 50 days to determine a medical emergency?! I call the USCIS daily, I've contacted my Senators office, sent emails...nothing is working.

 

any ideas would be greatly appreciated. thanks!

 

 

p.s, I haven't received any mail or calls related to my expedite.

My fiance got stabbed at the end of last September and I sent an expedite request to try and process our paperwork faster to get him out of that area since he had been threatened as well.   I asked where I could send the evidence and they told me I didn't need to send the evidence and that if they wanted some they would request it.  They ended up denying my expedite because I didn't send any proof in.

 

I think that took two weeks for me to get that response so then I did another expedite and sent the information in.  I called about a week or two later because the USCIS status said that a decision had been made on the expedite and I called and they said that it had just been given to a supervisor for review.

 

I have my Senator's office who had been following my case for some time to inquire.  I never got a response but two months later after I did the expedite request my I-601 waiver was approved (obviously so quickly due to the expedite being approved).

 

The customer service agents can't really see any more information than you can online so I suggest calling and speaking to a tier 2 officer if you have not, also getting your Senator's office involved if you have not done that as well.

06/2016- Third visit to Nigeria!
06/15/2016- Interview, given option to file I-601 waiver.
08/16/2016- Waiver submitted (no lawyer).
11/21/2016- Waiver approved with expedite.
01/2017- Embassy requested interview. 
04/2017- Fourth visit to Nigeria.  K1 officially denied. 
04/25/2017- NOA1 for 2nd K1.
07/27/2017- Case transferred to TSC.
11/17/2017- Case transferred back to CSC.
01/16/2018- NOA2!! (266 day wait)
03/08/2018- Interview (AP)
05/03/2018- VISA APPROVAL!!!
05/14/2018- Visa issued
05/18/2018- Visa picked up
05/25/2018- HE'S HOME!!! 💙💙💙

I know the response you got says the decision will be sent to you, but from reading on here, many (maybe most) denied expedites simply never get told, and the next time they hear anything from USCIS/ NVC is when their case processes along a normal timeline.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
