Can we still file I-129F since we completed divorce but waiting for Certificate of Decree Absolute

I know we waited till we had a copy that was recorded in the local court. It clearly showed the stamp. For the interview we will show the NSO copy.

OUR TIMELINE

MARCH 7, 2007 - SENT I-129F TO CSC

MARCH 13, 2007- NOA1

MARCH 19, 2007- REC'D BY SNAIL MAIL

May 23, 2007- APPROVED!

May 24, 2007- Rec'd e mail stating I was approved on the 23rd!!!!

May 29, 2007- Arrives at NVC

May 30, 2007- Called NVC and received MNL#

May 31, 2007- Left NVC headed to MANILA

June 4, 2007- Petition Arrives at USE Manila

June 12, 2007- Packet Mailed from Manila

June 25, 2007- Rec'd Packet

July 27, 2007- Medical appointment Aug. 3, 2007- August 3rd Interview, APPROVED!!! 149 days from filing!!!

Sept. 7,2007- Mary will be landing in LAX

If you do not include the Certificate of Decree Absolute, your petition will be denied and returned to you. Wait until you are divorced and can prove it.

Facts are cheap...knowing how to use them is precious...

It is more likely that you will receive an RFE for the decree absolute. Once you submit the decree absolute, if the date on the decree absolute is later than the date you submitted the petition, then your petition will be denied.

Yodrak may well be correct. In which case, the delay would be longer (perhaps months longer) than if they just denied the case to begin with. Wait for the final paperwork before you file.

I just read in the "VJ unofficial lawyer" section that he listed reasons for red flags on a petition and things that will have your petition sent to the fraud detection section of USCIS. One of the top 10 is very recent divorce followed by an engagement soon after.

I hope this doesn't happen to you. Don't let it discourage you but it is a potential black hole your case can slip in to.
