Hi all,

 

i really need some help here.

 

I travelled to America on the 12th April on the VWP to stay with my fiancé. I landed in Philadelphia at 2:30pm on the 12th.

 

My flight out of America was on the 10th July at 7pm which DialAFlight told me was 89 days. I have now found out that this was actually 90 days as the first day is counted.

 

My flight on the 10th July was cancelled due to a fire at the airline control centre in DC which meant several airports were shut down and I missed my flight back to London.

 

I was re-booked on a flight from Philadelphia to London on the 11th July which I got on. 

 

This is meant I overstayed the VWP by one day.

 

I was planning on going back in October to see my fiancé but I'm now worried I will be refused entry at security.

 

Has anyone had experience of a one day overstay?

 

please help :(

This is why it's recommended to never stay for 89, 88, 87 days etc. Anything can happen, never stay so close to the full 90 days.

You need a B, best to leave it is as long as possible, plan for him to visit.

As others have mentioned, you are no longer eligible for the VWP so either he will have to visit you or you will have to hope and pray you can get a B-2. 

 

But also be prepared for the amount of time you are spending in the USA to come under scrutiny. You will need to show strong ties to the U.K. With a love interest in the USA and a job that you can leave for several months at a time, it's not looking good. Even with the VWP there was no guarantee of admission in October as your travel pattern is starting to look more like living in the USA in installments and not occasional visits. No visa or ESTA approval is ever a guarantee of admission into the country.

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Oath: March 22, 2021 COVID-style same-day oath

I spent 40 days with my fiance (then boyfriend) and a further 20 days on a VWP last year. Applied for a B2 in October to travel with him as his job was in jeopardy at the time; and got denied. I think it was because I'm self employed and a part-time student, single female, no kids. The interview was over within 90 seconds and the CO asked for no evidence of ties to the UK (I own property, have work contracts, healthy bank account etc). The CO kindly mentioned it was something to do with my employment but gave me no other details.

 

I'm now engaged and on the K1 visa journey but if anything happened to my fiancé (God forbid) I can't even enter the US to be by his side right now. He's a full-time parent and he only has 2 weeks vacation time left this year so it's difficult for him to travel to me. We've a good few months wait ahead of us for a K1 visa interview. It's an awful feeling and position to be in especially having been turned down for the B2 which canceled my ESTA. 

 

I just wanted to share my story to help you make a decision regarding a B2 application / K1 application

Your situation is different, sounds like you had no reason to apy for a B as you had previously travelled on ther VWP, OP can not use the VWP so a B or nothing.

 

Presumably you updated ESTA with your B refusal and were declined. You can always try again.

dont people realize delays happen in airports ALL THE TIME? i would never visit over 85 days for this reason alone!!! not to mention im sure it never looks good to visit and stay the full 90 days.

 

now you have to apply for a b2 with almost a 0% shot of getting it!!!

Yes, it is slightly different as I didn't overstay. And yes ESTA declined due to B refusal. 

 

Hey, they must've known something I didn't at the time as now I am an intending immigrant - so the CO's decision was correct, but we're currently in extremely frustrating circumstances :(

its because what can you do in 6 months that you cant do in 3? to get a B2 from a VWP country you need a VERY good reason to need one!  not sure if people realize that beofre they apply for it.
