My husband and I (married less than two years) are going to send in the I-130 package very soon but after reading about the K-3 and how he can come and live and work with me in the US, we're both left a bit confused. If I'm understanding correctly, after we submit the I-130 and that gets filed, we can then send in the I-129f form. If/when the I-129f gets approved, does that then mean our case will be handled as a non-immigrant visa, meaning he won't get a green card but merely a visa (and then applying for the adjustment of status)? Or will this just allow him to come and work while the CR-1 is pending and he will still get a green card?

Just stick with the I-130.

K3 is rarely granted and pretty much obsolete at this point.

K1

29.11.2013 - NoA1

06.02.2014 - NoA2

01.04.2014 - Interview.

03.2015 - AoS started.

09.2015 - Green Card received.

24.07.2017 - NoA1.

K-3 is obsolete. It's still on the books but it will almost certainly will be administratively closed. The I-130 will remain open for the CR-1 visa. K-3 is a relic from back when CR-1 was taking multiple years to process.

Okay, but there isn't something we could do while we wait for the CR-1? We know it's a year or so, but would rather not spend many months apart.

Nope.

Except trying to apply for the tourist visa and see if you can visit each other.

When you say "isn't there something we could do" what context are you referring to?  Are you talking about visits to the US, or something else?

 

i agree with the above posters, the K3 is essentially obsolete and not as beneficial to the CR1, so I would just stick with that submission and forego the I129f.

As otherwise stated K3 visas are pretty much obsolete now and I think they only granted like 300 at the most last year. The majority of people that file for it automatically gets converted to a CR-1 visa. So just go ahead and file for that visa. 

 

We here on VJ understand how y'all want to live together because we have all been there before. But we have or are going through the same thing right now and are helping each other the process.

K3 visas have been obsolete since 2010 but they never allowed work in the USA, and even before that, they didn't save more than a few weeks of apart time since 2006.
