New I-864 for interview?

Hello all,

We are preparing for our AOS interview at the end of this month, and I thought I remembered seeing somewhere that the spouse has to fill out a new I-864 affidavit of support to take to the interview. However, on the request for applicant to appear notice, it says to submit one "unless already submitted"--which, of course, we did. Can anyone shed some light on this please? Thanks!

Unless your financial situation has changed since you filed for AOS, there's no reason to bring an updated I-864 in my opinion.

You may also want to bring your sponsor's 2006 tax information and W2s even though it wasn't requested.

did the letter not say under the I-864 section that you need to bring the last 3 year's tax returns and a letter from the sponsor's employer??? well you did not have to send these when u initially sent the I-864 so i would assume that since they are asking for new things for the I-864 that a new one would be needed. i am also wondering about all this cause my interview is on May 10th.

Your sponsor's employer letter needs to be included with your I-864 application, otherwise you'll get an RFE for it. You need to take whatever is requested on your interview notice unless already sent in. In which case, you can just take originals and photocopies of supporting documents you sent with your application. At least that's what I did 'cos I didn't make copies of my actual AOS application forms. When it comes to the interview, you can never have too much evidence. So, it's best to take everything you've got. Sometimes the officer may not even look at everything, but then you never know. Good luck.

i actually never sent a letter from my sponsor's employer when i sent in my I-864 and never got an RFE for it. but i guess i will take one with me to the interview just in case

Untrue. Some people have got RFEs for this, but it is not guaranteed to get one by any means. The employment letter however is not a requirement, only the last tax return is a requirement.

I erred on the side of caution and provided 3 years taxes with W2s as well as an employer letter AND 6 months of pay stubs.

A good idea, definitely.

I just wanted to counter the "forum wisdom" that not including the maximum amount of evidence will guarantee an RFE. I filed I-864 with just my wife and I's joint 1040 from 2005, and never got an RFE. Nor was I asked for any addtional evidence at the interview. I also was using my own income to "self sponsor" as my wife is a student.
