Hi everyone, looking for answers about my situation. I was working in kuwait where i met my son's father who's now my ex .. i got pregnant in kuwait and got scared that i will be in jail if I won't go back to Philippines .. one of my colleagues said that they know someone who make  fake marriage certificate. It's just to show whenever there is a police checking .. me and my ex agreed to it, my ex doesn't have contract,  their company let them exit every three months then come back to work.. so unfortunately he doesn't have CIVIL I.D .. the guy working for fake marriage didn't allow my ex as my husband on my fake marriage coz he doesn't have civil i.d .. so i asked my friend's boyfriend who is a muslim and local from kuwait .. he agreed after telling him it's fake .. i was 8months pregnant when i came here in Philippines for good .. after a year me and my ex decided to get marry, unfortunately my supposedly fake marriage got registered in NSO 😥😥 i was so shocked and upset,i contacted the person who made it and he saidhe will divorce it .. we just need to pay 50k. We paid him but my divorce didn't happen .. till me and my sons father broke up .. my american fiancé is now paying a real attorney to fix my divorce .. but i had doubts when i heard that divorce is getting denied by the embassy now ☹️we we're thinking about getting it null and void coz i don't have signature in my marriage certificate but tge attorney said he can work on getting it divorce.. i Don't know what to decide about it .. i just wanted to know if, will i be denied if i just divorce my marriage?? .. thanks in advance for the response ..

You are not going to get a K1 with records showing you are married, so the Lawyer sounds a good idea.

Does it show up as you getting married under a Sharia marriage or a regular Christian ceremony? Also are you sure the lawyer is going for a divorce or a annulment?

Yeah it shows that im married under shariah law.. he told me at first that since i don't have signature and i have all the proof that i was single in 2010 (marriage was dated in 2010) .. then he said we can file for null and void .. then he told me just recently,it will be better to divorce it..

You need to forget about mentioning "Sharia Law" because I think in Kuwait an Islamic marriage gets processed & recognized by the country.  So you have an official marriage recognized by the country which is Kuwait now.  I can go get married in Sharia Law and not process it with the government in any Muslim country.  I am a Muslim and I know this.  You are supposed to process it, but if you don't, then its not recognized by the country.

I guess what I am saying is, your marriage started as an Islamic marriage, but then was processed with the government which made it official and recognized by the government.

I will give you an example, when the Imam comes to your home or you go to the mosque and the shiekh announces the marriage......thats Islamic marriage and he gives you the marriage contract which you are supposed to go process it with the Judicial Ministry.  When you walk out with the marriage contract the shiekh gave you, you are married under the Sharia Law.  You are married, but its not recognized by the government.  As soon as that contract gets to the Judicial Ministry and processed, then you are married in the eyes of any government in the World.  It sounds like you are passed the religion marriage stage and your marriage was registered with the government.  If so, then you need to peruse an official divorce.  I guess what I am trying to tell you is, your marriage is not an Islamic marriage now, it's a marriage recognized by the government

Are you in the Philippines? Because what you are saying does not make sense in the Philippines and is giving her bad advice. She is legally married under Sharia Law by the Philippine government. So that means she is allowed to get a sharia law divorce and it be recognized by the US embassy and the Philippine government. 

 

The only time that a Sharia law divorce is not recognized by the US Embassy in Manila is when the intial wedding was done in a church and now they are trying to get divorced using sharia Law.

You can get a divorce under sharia law and it be recognized by the US Embassy because you got married under sharia law. The only time it is not recognized is when you get married in a church and then get a sharia law divorce.

I live in the USA.  What I was speaking about works for 99% of the Middle Eastern countries when it comes to marriage because I lived in Kuwait for over 8 years.  I myself went through a divorce here in the States and I can tell you in the court, they only recognized my State Marriage.

 

I am not sure how it is in the Phillippines, but in the Middle East you can get an Islamic Marriage, but you must process it with the Judicial Ministry. 

 

I got married in Dec 2016 in the Middle East and the Shiekh came to the house and I got the Islamic marriage.The contract or Islamic marriage license was written by the Shiekh.  He then told me "You are now married and she's your wife."  Then he offered me to either take the Islamic license to the judicial branch to get it stamped and then to the Internal Ministry to get another marriage license which is recognized by the US Government.  I went through all that and I ended up with the "Islamic marriage License" and the "Internal Ministry Marriage License."

 

When I came back to the States, I sat down with an immigration lawyer and when I showed him both licenses, he told me the Islamic license is not accepted by the USCIS.  They want the marriage license from the Ministry which I had.  I am telling you what I went through.

Ok I understand that but if you read what the OP wrote she is in the Philippines now. So what you are saying DOES NOT WORK IN THE PHILIPPINES.

I reread what she wrote and it's confusing.  She first was talking about Kuwait and how she went to a guy who does fake marriages, then jumped to bring pregnant and marrying and getting divorce.  I thought she the marriage in Kuwait that's why i replied.

It sounds like she was a OFW working in Kuwait and got pregnant by her BF, the BF did not technically work in Kuwait due to the company not going through the government to process the work visas. She then panicked because it is common for a unwed worker being either sent home or put in jail for having sex out of wedlock, she then got married to a Muslim Kuwaiti.  All of which this is VERY common in the Middle East countries like Bahrain, Kuwait, UAE, and Qatar. She only found out that her previous "fake" marriage somehow got registered by the NSO when she actually went to get married to the child's father.

 

So she is trying to figure out what to do now since she has a marriage on the books with the NSO, but luckily for her she supposedly got married by Sharia law so the USEM will approve of that divorce.

Yeah it's very common for a OFW(Filipino Overseas Foreign Worker) to get married if they get pregnant with a child out of wedlock in the Gulf. Sorry I jumped on you, I was just wanting to give her some good advice.

Im sorry i wasn't clear..😬 the guy who did my fake marriage is filipino and he registered the marriage here in Philippines .. my husband (on fake marriage) told me he's not registered married in Kuwait .. 😐
