Incomplete RFE Reply

Hello all. I'm really worried about my K1 Petition.

We received NOA1 from our 129f on February 2, 2017.  I received an RFE  mid-June asking for a Certificate of Conviction and a copy of my 1997 Divorce. The RFE gave until August 14, 2017 to reply. The divorce records at court  were destroyed in a flood years ago and only sent the Conviction Certificates without the Divorce explaining my situation. I had no idea how long it would take to get a new Judge to sign/re-issue my 1997 divorce.  Two (2) days after mailing my first  RFE Reply (Conviction Certificate only), I received  the new Judgment and mailed it to USCIS that same day with another copy of the blue RFE cover sheet.  My Case status only shows USCIS' receipt of my first mailing  and not the second mailing.  It's been 30 days and no change.  To be safe, I sent a 3rd RFE Reply with both the Judgment and Conviction Certificate  today with another copy of the RFE cover sheet.  Of course I used tracking so I know USCIS  CSC got the mailings

 

Lately, I have been reading on VJ that we only get one chance to reply to an RFE and that has me very frightened.  There seems to be no way to contact USCIS other than the Correct Mistake option on My Case page (which I did, explain that I mailed Divorce Judgment  2 days later).  I'm so nervous that I ruined our Petition and need to start over again.  Any suggestions, anyone??

At this point all you can do is wait. 

 

Hopefully the second or third package got matched up with the first.

Day 341 (12/10/18) Interview was scheduled for 1/14/19

Day 376 (1/14/19) Interview

Day 385 (1/23/19) Denied

Day 400 (2/7/19) Denial revoked; N-400 approved; oath ceremony set for 2/14/19

Day 407 (2/14/19) Oath ceremony in Dallas, TX

Timeline

Yesterday My Case was updated to reflect they addressed my Correction that I submitted online. I believe I'll be OK they now know I submitted everything requested by the RFE over 30 days before the August 14 deadline.  I'll feel so much better when NOA2 comes and this case moves to the other side of Earth. Pity on my K1 GF

To be honest, I've seen people here sending in additional documentation before it gets requested, and, despite people here saying not to send info after the fact, and despite the USCIS saying the same thing..... Sometimes they read it anyway. Sometimes they don't. Depends on who is working on your case.

 

Either way, an actual physical human WILL get your mail, and if they see an open case with the evidence you submitted, I don't see why they would reject it out of principle if it helps your case. The USCIS has repeatedly stated that they WANT people to succeed, and they WANT the evidence. If it saves them from sending a second RFE, they'll take it - trust me.

 

Keep in mind though that getting the NOA2 is just the first step. You both have a very long way to go.

Thank you Peot. That was a good point that I missed.  I'm too close to my own case and don't see it clearly sometimes.

BTW, My error correction via My Case received a Reply  acknowledging my correspondence  so I'm back to patiently waiting for NOA2 (again).
