I agree with many things said here.. if your ds or visa do not say subject to the 2yhrr then you should do the advisory opinion just to be sure (it takes about a month)

If they do say that..then you are subject and you need to either wait the two years or get a waiver.

 

I understand how horrible this is for you.. I knew I had the 2 year requirement and came home to do them.. after only 3 months I couldn't take it and had to apply for the waiver.. being appart from your loved one is the worst.. specially after you were together (like in my case we lived together for almost 3 years)

I requested the NOS from my government early April and started by application with the DOS

2 months later on June 15 the DOS received the NOS from my embassy.

Today July 14 and I haven't received favorable recommendation, but they emailed me telling me my case was being reviewed by one of the officers..

 

I also applied for a K-1 in the hopes the waiver gets approved by the time I get NOA2..

 

If you decide to wait until the 2 years are over, take into consideration that any time you spent in the US gets added to the 2 year time (which means.. it has  to be 2 years outside of US)
