Married on esta? Adjustment of status? Help!!

Hi. I arrived here 2 months ago on the visa waiver programme. My fiancé and I are planning to get married and apply for adjustment of status for me. I posted previously and people were very helpful and ensuring me that they did the same and everything went well. I downloaded all the forms in the step by step guide and have been reading through them. Would you file the I-130 and wait for that to be accepted before filling the I-485? Is there anyone who can help me who have been in the same position as us?

file them at the same time. Waiting for the I-130 to get approved will only delay your case and extend your illegal presence.

Ok the reason I asked is because on the I-485 part 2 it asks why you are app, yang for permanent residence status. A) says an immigrant petition giving me an immediately available immigrant visa number has been approved. I'd assume this would be my answer but I don't have a visa number.

The 130 application, when approved, would give you an immediately available immigrant number. so you can apply concurrently.

Ok so I would just file them all at once and check box A for this but I just wouldn't send the approval notice(that I wouldn't have)

sorry I have just been reading through all the forms trying to get my head around it and ask as much as I can on here.

I just checked my form and that's the option I checked (A). We filed concurrently as well and had zero problems. I assume they first go over your i-130 and then your i-485, even if they're in the same package?

no worries, it's a lot to wrap your head around! Make sure you also include i-765 (work authorization) and i-131 (travel document) for when you want to work/travel while the green card app is pending. It can take a while.

oh yes. A general cover letter listing the 4 petitions, and a cover letter with each petition detailing every single document included. I attached it but please note that some documents have changed in the meantime (no G325 necessary with i-130, I believe).

Good luck!

google the name of the form and make sure you download it from uscis.gov That website also comes with instructions for each separate form, and you can also find the fee there

Ok thanks. I am just looking again at form I-130. It asks about the beneficiarys job. I had a job obviously when I came here but gave it up as I decided to stay. Would I put the work details or would I write unemployed? I just want to know what would be best incase it looks suspicious if im unemployed? Would they take that as I intended to stay?

Always tell the truth. the date your job ended would show that you still had a job when you arrived in the US, and I don't think it'd be cause for denying outright. You'll have the opportunity to explain during the interview (if asked). Working right now would be illegal in any case, so that could get you equally in trouble.

It says that because people apply for AOS from work visas. They legally live and work in the US. You are not allowed to work yet so say unemployed. It would look suspicious if you said you were employed.
