Hi me and my husband are currently collecting documents for our AOS and IV packs. (Filing for spouse visa CR-1)

 

There are a few things that he is not sure about - any help and clarification highly appreciated!

 

1) Proof of Domicile 

Does this mean a copy of our apartment lease? 

 

2) Form(s) W-2 

Is this form necessary for CR-1 spouse visa application ? If so -  where can we find it?

 

3) Social Security earnings statement

same as above - Is this form necessary for CR-1 spouse visa application ?

So are you applying for aos or cr1 visa? Two different things.

06.02.2014 - NoA2

01.04.2014 - Interview. 

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

I am residing in the Uk and my husband is an American.

 

I am applying for the cr-1 visa (which you need to forward packages called aos and iv) to the NVC.

 

These items came on the NVC welcome letter!

As far as I know there is no such thing as aos within the cr1 visa...

09.2015 - Green Card received.

24.07.2017 - NoA1.

Does this mean a copy of our apartment lease? This is only required if Petitioner is residing abroad and needs to establish US domicile so they can sponsor your immigration.

 

2) Form(s) W-2 

Is this form necessary for CR-1 spouse visa application ? If so -  where can we find it? This is required for the Affidavit of support.  W2s are statements issued by the employer stating income and taxes related to the employee wages.  They are issued on an annual basis and are considered proof of income. See link provided below for details.

 

3) Social Security earnings statement

same as above - Is this form necessary for CR-1 spouse visa application ? Required if you are using Social Security income to supplement the Sponsor's income to meet financial requirements.  See link for details.

@JessieABC I just spoke to my husband and because he only moved back to work in the US from less than a year ago he said his W2 would not be available. In this case should we just write a letter describing why it's unavailable and have it signed by his employer ? Do you know what people do in this case?

In order for your husband to satisfy requirements, he would need to meet financial requirements.  Typically, this is determined by his income as stated on his taxes.  If he filed his 2016 taxes as married filing separately, then all he really needs is his IRS tax transcript reflecting satisfactory income.

 

If he filed married jointly, he would need proof of his individual income and that it meets the requirements.  This is usually established via a W2 which reflects individual income and not joint as shown in the transcript.  

 

If he did not file US taxes for reasons of a tax treaty or other exemptions, then he must provide a letter stating why.  If he didn't file US taxes AND he will be acting as your sole sponsor, then he will need to establish US domicile, and provide evidence of meeting the financial requirements via the methods stated on the NVC site (i would suggest including everything possible, e.g., letter from HR on corporate letter head stating income, employment duration, title, annual pay, signed).

 

In some cases, a joint sponsor is used to satisfy the requirements either due to inability to establish domicile or lack of sufficient income/assets to meet requirements.

 

I would need to know more information on your situation - could you provide more details?

Okay! He filed separately and we have the IRS tax transcripts for his last 3 years with much over the income required. So I'm assuming we are in the clear with the IRS transcripts ?

Should be unless the nvc makes a mistake ( as they are prone to do). I would include an employment letter and pay stubs just to be safe. Annual pay should be apparent on at least one of the two.

 

From the checklist stories I've seen, those requesting for w2s are usually when either a joint sponsor was used or when the sponsor had filed jointly.
