I was living in Brazil with my husband, american citizen, we met there , marry there for 2 years...there he had no work to taxes. I was working there. WE come to USA 4 months ago , he is working and is earning enough to be my sponsor.

All matter is that he has not tax income from last 3 year to put in the form. So we are married in Brazil, first than here, 2 years ago...here we marry last april. So I need some insight in this.If I apply writting a letter telling this true about us, they could take it in consideration that has no tax because he was out of country? Thank you

For a B2 visa, there is no need for taxation information. 

 

If he's trying trying to file for CR-1 or IR-1 spousal visa for you to live in the US with him, then that's a whole different story. I can't answer you on the taxation part but if anything, he does need to prove his domicile in the US. On top of that, if his income does not meet the poverty guideline or he has zero income, he will need to find a joint sponsor when filing for you. 

 

The more knowledgeable VJ members will be able to answer the taxation question :) Either way, all the best!

Thank you for reply me. So I was living there Im here in USA 4 months ago, and I was to apply I-130, I-485, and I-864 but we cant prove taxes that is required in this form. I not know much about CR-1 or IR-1 that you mentioned. That is good that someone can help me to apply the correct forms. Thank you.

September 2007: Met online via social networking site (MySpace); began exchanging messages.
March 26, 2009: We become a couple!
September 10, 2009: Arrived for first meeting in-person!
June 17, 2010: Arrived for second in-person meeting and start of travel together to other areas of China!
June 21, 2010: Engaged!!!
September 1, 2010: Switched course from K1 to CR-1
December 8, 2010: Wedding date set; it will be on February 18, 2011!
February 9, 2011: Depart for China
February 11, 2011: Registered for marriage in Wuhan, officially married!!!
February 18, 2011: Wedding ceremony in Shiyan!!!
April 22, 2011: Mailed I-130 to Chicago
April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

all my matter is that I will need apply I-130, ok. I-485, ok. but I-864, my husband had not tax return, no income in the last 2 years because he was with me living in Brazil. So I need know if is possible we apply and speak separatelly in a letter this issue. that we lived in Brazil and he have no number to put in the form. Someone passed for this situation?

it is current income that counts. you said he makes enough to sponsor you so you need pay stubs and W-2. Enter zero income for previous 2 years and whatever he makes now for this year. you can also add later explaining why he was earning any money because he lived in Brazil.

we learn today that we can apply I130, I485 and I-765 that would help to start in this process of legalization. what you think? very appreciated your input. thanks

ah so inocent im the 864 is in the list of required matters in 130 form , lol

You can't marry twice, the first marriage is the only one that counted.
