Hoping to get some more opinions on something, CookieCat answered before on this to me but I wanted any other input and suggestions:

 

I became a LPR in 2005. In 1993, I committed "theft under $1,000" in my country of Canada and was made to pay a Court fee of $20.00 and then sent on my way with charges withdrawn. I was never placed in handcuffs, never entered any sort of plea, just asked to state my name for the court, read the charge, and then judge told me to pay the $20.00 administrative court fine before I left. No probation or anything else.

 

I already disclosed this on my I-485 AOS when I first got my green card and submitted certified document saying the records had been destroyed because it was so long ago. Now I am filing my N400.  I can't get anything other than a certified court statement saying the exact same thing the old  letter says---records are (still) destroyed.  I have not had any other offence since 1993, not even a traffic violation in either country.

 

My main question is this:  Do I need to get another court certified document saying the same thing or can I just submit photocopies of the original 2005 letter submitted with my prior I-485 with a note on the cover letter stating that they already have the originals declaring records were destroyed because it happened over twenty years ago?  I know that during my interview they will have my entire file in front of them....would my application even get accepted for processing without another original submitted?

 

I can't wait much longer before filing my N400 (I did send away for another certified letter to bring to the interview) as I want to make sure my receipt date is before my GC expires so I can avoid the extra fee for that too.  Getting my first original letter was hard enough when the occurrence happened 13 years ago and I had to disclose it---now that it's been *23 years* ago it's damn near impossible.   I'm hoping with the copies (and promised originals--again---explained on the cover letter), they will at least begin to  process my application instead of rejecting it and sending it back.

 

 

I swear, I thought all of this stressing out over USCIS / INS all over again is going to drive us all crazy by the time we DO become citizens LOL!

@Going through With USCIS, they might have your document on file or they may have lost it (which happens more often than not). Best case, no risk scenario would be to send the original document BUT then again they always ask for photocopies. According to US Consulate Website:

 

 JUDICIAL AND PRISON RECORDS: Persons who have been arrested for any reason in any country (including the United States) or who have any judicial/prison record must present copies of ALL documents related to the case, even if there was an amnesty or other act of clemency or even if the person was found innocent or the charges were dropped.

 

If I were you I would send in the photocopy with a letter explaining how it happened 23 years ago, the documents were destroyed and you had previously sent in the original court document. Cherry on top: you could have your lawyer attest to it as well to give it more credibility. Best of luck!

It says that: USCIS requires applicants to provide court dispositions certified by the pertinent jurisdiction for any offense committed during the statutory period.  

 

Since you case happened 23 years ago, it does not fall under the 5 year statutory period. This is the link to the entire manual:

It was updated June 28, 2017 so its the most recent version.

That does make me feel a bit better!  However, we both know that the adjudicators never seem to be on the same page with each other as to what they require.....and in the policy it also says " In addition, USCIS may request any additional evidence that may affect a determination regarding the applicant’s GMC" which basically gives them the loophole to ask for anything they want.  And considering it was still a CIMT even though it was 23 years ago...well, I'm still worried.  However, as my husband says, all I can do is "try" and see if they will accept the photocopies of prior originals submitted.  

 

I don't mind trying to get another original letter to show during my interview...my main worry is that they won't even ACCEPT the application for processing without an original.  Maybe I'm stressing out about it all too much.
