Hi all:

I am in the process of applying my fiancee to come to the US from Hong Kong. the K1 visa was approved and our last day of entry is at September 2nd. 

Here comes the twist: 

In early July, my fiancee was diagnosed with cancer and she need to undergo 2 month of treatment in Hong Kong and a lengthy recovery process. By the time when she finish treatment, it should be hitting really close to the visa expiration day in September. And she needs to be at her follow-up session in Hong Kong the month after her treatment. 

There are two options regarding finishing our K1 process. 

1. Stay in Hong Kong and let the K1 expire and re-apply when ready. 

2. Go to U.S. anyway before expiring and get marry asap, apply for advanced parole and then leave US for treatment and comeback when ready. 

 

So here's my question mainly regarding option 2:

1. What is the approximate timeline for getting a advanced parole issued assuming we will get marry as soon as we arrive? (if it helps I am a citizen from California)

2. I have heard once application for status adjustment and advanced parole have submit, it will take a while for petitioner's immigration record to be established. Once the record is established, then she can leave the US and wait for the advanced parole to be process and mailed properly.  (this concept is still fuzzy for me now, so if you find things I wrote confusing, excuse me)

 

The timeline and process of option 2 probably affects our decision dearly, thats why I go out and ask similar experience.

You might want to contact the embassy as well to see if there's any way you can have the validity of the visa extended. It's obviously not guaranteed but if you show hospital papers as proof they might actually help you out. It's worth a try.

 

1. Normal time frame is 3-4 months, but if you have hospital papers showing the emergency you might be able to get it expedited.

 

2. The foreigner should absolutely not leave the US without having the AP in hand, I don't think anyone in here would recommend that.

Thank you Scandi,

I had contacted the embassy. It replied it wont be able to extend the visa, it will however accept we re-apply the visa when we are ready. The process should be just start from form DS160, the police record, the health inspection, and the interview. (no I-129F stuff all over again)
