Hi guys, I have a quick question. We applied for a student visa for my girlfriend two months ago and she was denied. They did not know about me on the application for a student visa. She was denied because she did not have strong ties to her home country (she was poor). My question is this: will being denied for a student visa two months ago hurt our chances of getting a K-1 visa now?

Thanks in advance,

Rodney

PS - we are going to apply for the k-1 visa as soon as we get all the paperwork together.

Not really. If someone has been denied 2-3 times trying to visit family in Nashville and then a petitioner from Nashville files a K1 petition for them immediately after the last refusal, that might be reason for extra scrutiny of the relationship.

But a nonimmigrant visa refusal in and of itself isn't something that's going to be problematic. I'd say 30-40% of the K1s I see have previously been refused B visas (and rightly so).

No it will not be a problem. My friend who is now my spouse got denied three times in a year, but got approval for the K1. Unless she lied (which doesn't seem to be the case here), you are fine.
