My husband went to Mexico with an approved 1-601a waiver admitted to smoking marijuana a few times years ago and got a 1 year ban. No POS drug test. He's been to a second interview and physical and was then told he needed a new waiver so applied for I601 waiver in March 2017. I and our 4 year daughter have not seen him in 17 months. I've been on Ambien to help me sleep and had to move with the only family member I have here my 80 year old grandpa who colon cancer and selling his house. I can not afford rent on my own cause most of my check pays for child care. I did not want to apply for goverment assistance cause it looks bad there are no funds where I live. Anyway besides posttraumatic stress disorder for me and my daughter and being on many medications. We will soon be homeless and there are no homeless shelters for women and children in my area so I can keep my job and insurance. Also I made need a surgery soon for hernia and scar tissue. Do you think we will qualify for expedite. My grandpa does not take care of us I was taking care of him but I can no longer afford it financially, mentally and physically. I have sold most of everything and got rid of storage and can prove that we are making plans to start living in car, I do not want to give up my job, I make decent money and have insurance but paying all living bills and daycare alone I'm 500.00 short every month.

Maybe if he a  job offer in the US? My basic view is if in doubt expedite, the downside seems to be a small delay if it is not approved.

 

Your basic argument is financial hardship and that if expedited he will have a much better paying job.

We have submitted letter from his previous employer twice, with our waiver he had been there for 12 years and was the sole bread winner while I was in school and not working. But then we also did not have a daycare to pay. I miss understand your comment. So doing this expedite could delay things?? That does not seam fair at all....... I am tired of my life and decisions feeling like a roll of the dice. These are real people and emotions the gov't is playing with. I considered writing my senator as well?

Nobody can quite be certain but it seems if the application is pulled out and not granted then it loses however much time was used to review it.

 

Sounds like you are in normal processing time so no a lot a Senator could do. Obviously nobody likes how long the process takes.

Well I don't think there is nothing normal here, My husband left with everything the way it was when it was two of us thinking he would be gone a few weeks, well he has been gone for 17 months. The way things are going right now it will be another 9 months or more before we will even here about this waiver. I have given everything up and sold everything I could. All I have left is my job, daughter and a car with insurance. We will be living out that car soon. There is no assistance where I live or shelter for women and children. I am stuck and have no clue what to do or where to go? Has no one else been at this same place???? I can quit my job and live off government assistance but I don't want too, it's not right. I can work and want to work.  What is normal processing time?

The normal processing time for a Spouse Visa is 12 months or so plus say another 9 months if you need a waiver.

 

Now you had a 12 month ban for drugs so that would be in addition. No expedite for drugs ban.

 

I 601A is super quick, but you have to be otherwise clean as it is only for illegal presence, most people do not have access to that.

 

Now looking forward last time I looked you should be getting a waiver response towards the end of the year, obviously processing times do slow down and speed up.

We don't need expedite for drug admittance we completed that time already. We had I 601A waiver and approved before he left but we did not know telling the truth about trying drugs once or twice was gonna overthrow that. It is up to the discretion  of the physician, we just did not want to lie, see what be honest gets you. We learned are lesson that is for sure. We have seen so many people go and come and most of them have lied. :( We started this process in 2014 with the I-130. We have gone above and beyond what they have asked for been to all appointment and paid all fees twice. I understand they speed up and slow down. What makes me even more upset is that i talked to consulate general and was told all we needed to do to overcome this was a new physical and interview. We did that and get hit with the 930.00 waiver, plus all the other fees and getting there and back. Also that they tell my husband that this is for a better future for you and your family. Me and my 4 year old and 11 year old are about to be living out of my car, cant wait till the public school get wind then CPS might get involved. I really don't see how this is better for anyone. I guess we wont be dong the expedite. I will be checking into quitting my job for welfare and assistance cause that's how they won't us to live anyway.

You say you can not afford rent / this is more of a problem than expedite case

you need to pass the income requirements / paying out most of income for child care and not having your own place to live will mean you may need cosponsor

i am not trying to discourage you / just be aware of the poverty income requirements for spouse visa and be prepared

How is she going to afford rent? Didn't u read her husband was the sole bread winner?

You have a child to think about FIRST.. Go get the assistance you need to take care of that child. You can get emergency food and housing for you and the child. Take it from me....you have to worry about you..  Waiting on a waiver is not the end of the world. Find yourself a life here without him. In my honest opinion, I would assume all processing of waivers for criminal offenses are being reviewed very closely since Jeff Sessions became the New attorney General. I'd be surprised if they approved an expedite. 

Please prioritize your child. Apply for assistance. What if you lose your child because you're living in your car? Is he worth that?  I'm guessing no.

These are things we have already been through, we have a sponsor already cause when we stared this I was working and in nursing school full time. We have that. I just was not sure if financial loss and surgery for me were reasons to expedite. I see financial loss to person or business listed and surgery for applicant. If anyone who has experience with expedite can let me know I would greatly appreciate. All the things i am being told now i know and have already done. Like i said we have done two physical and 2 interviews. We had i601a waiver approved in 3 months after we applied when hubby when in US. I am sure we show more of a hardship now that he has been out of the country for 1 year and 5 months. I601 sent April 2017. Thank in advance

 He has no criminal charges he has overcome the admittance to smoking marijuana twice years ago at his physical. Also there is no assistance currently where i live. I applied for daycare assistance and its a 2 year waiting list i went from #188 to #145 since January. I dont qualify for food stamps. There is nothing else to apply for. My husband means everything to me as do my kids. I would not move on from my husband my kids would be more devastated than they already are.

She could afford rent if she sought out assistance.  

My neighbor had a 601A waiver approved..went back to Costa Rica to get his visa and it was flat out DENIED. He thought he would be back in 2 weeks..he's been gone over a year now. His wife moved on ..sold his truck and is happier than ever. He has a kid here too..and no drug charges.. He was illegal here for 16 years. The government isn't playing anymore... DACA will soon be gone too. 

My suggestion  is... Live your  life..take care of your child.  If the waiver is meant to be approved...it will be approved. 

I waited a very long time through this immigration process. IT WAS NOT EVEN CLOSE TO BEING WORTH IT.
