Timeline

Hi,  I am a bit confused about the process after we get married.  I understand we need to have him apply for a EAD and AOS at the same time, however does he need to also apply for a SSN?  He does not plan to become a US citizen as he wants to keep his UK citizenship.  I wasn't able to find any information on the AOS links to get a better understanding.  Also does anyone have an idea of what the EAD timelines are looking like these days?  I'm based in Texas.  Thanks for all the help!

He'll need a SSN if he lives in the US. SSN does not affect his UK citizenship.

Apply for the SSN the first week or two after he enters the US.

 

The EAD takes about 3-4 months from the NOA1 date.

K-1: 12-22-2015 - 09-07-2016

AP: 12-20-2016 - 04-07-2017

EAD: 01-18-2017 - 05-30-2017

AOS: 12-20-2016 - 07-26-2017

ROC: 04-22-2019 - 04-22-2020
Naturalization: 05-01-2020 - 03-16-2021

Just a note, it is a misconception that SSN can only be obtained after EAD or that EAD is needed to get SSN. For some visas, yes,  you do need an EAD before you can get the SSN (since it would be a work visa), but not for K1.

If he wants to get paid or make it easier to add to your medical coverage then yes get it but you don't do that through USCIS - ssn not required to add to medical but most people who do the processing are adamant about it and so it's easier to use the Ssn.

Getting us citizenship does not require you to give up uk citizenship, simply put HRH does not give a rats posterior what you have promised the US as the only way to rescind uk citizenship is to apply to the U.K. Government and expressly apply to do it. The us hasn't required new citizens to rescind their other citizenships in order to become us citizens in years

It's no longer necessary to wait due to the electronic processing of I-94s into the SAVE database system. You can go as soon as you've entered the country if you so wish.

 

OP, your husband would not automatically lose his British citizenship by becoming a naturalised American citizen either.

Also apply for AP (Form I-131) along with AOS/EAD. It's free when you are applying for AOS. It's what allows him back in the US should he need to leave before he gets the greencard. Even if he has no desire to visit home, things happen that you least expect. He can't come back on visa waiver (ESTA) or his K1 visa, so he is stuck out of the US and will have to start over applying for a spouse visa. Also the AOS is considered abandoned so you lose all that money. Apply for AP just in case you want or need to leave the US. 

 

PS. I hold US and UK passports. It's useful to get US citizenship.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
