Ok, I'm finally ready to submit my I-129F but, I truly want to avoid needing a sponsor.  I currently have one child that lives with me and my other child now, primarily lives with my ex-husband.  I claimed both kids on my taxes but, I have a notarized letter stating that one child lives with my ex-husband and that he is their primary financial provider.  My primary job, which shows on my taxes, I make $16,000.  I started a second job about 9 months ago, where I make around $15,000/yr.  I have a statement from this employer on their letterhead to support my earnings (this is a 1099 job, I'll claim them on my 2017 taxes but, didn't claim them on 2016 because I made less than $600 last yr). 

 

With the information I've provided, can anyone advise if you think I'll need a sponsor or if I've provided enough information to avoid having one?

If you get 1099 then you are an independent contractor. I was in the same situotion with my husbands jobs. I got a RFIE for insufficient income and responded back with :

1.letter from the employer from the W2 job

2. All the paystubs he was ever issued 

3. Employment data records

4. The immigration verification from the work number . com 

5. Independent contractor contract (1099 job)

6. Letter of contract Verification from both husband and the other side of the contract 

7. Letter of earnings verification from employer (1099 job )

8. 2016 tax return 

9. Printed out the poverty guidelines and highlighted the applicable row

10. Bank statements with highlighted deposits from both jobs 

all worked out good. But it was regarding Affidavit for support for my green card 

hope it gives you some ideas about what can you submit :)

If your husband is the primary financial provider and/or custodial parent, didn't he claim at least one of the children on his taxes? One child, one claim, one deduction is the rule for divorced parents. It seems he is the parent that probably needs the deduction, not you. If you're not making much income, why did you take the deduction? And if you took the deductions, that will likely put your household at three, not two, thus increasing the poverty level limit. You may have a tough time proving income. I'm not a CPA, but I'd be concerned about some tax issues.

you can send yout i-129f package, the income issue is at the interview stage.

so you can send your package now, and the tx information will needed at the interview stage, you have time to see what to do in some months.

January 11, 2023 oath ceremony, Indianapolis. After that done with uscis😂🤭🤫

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

01/11/2023 officially done with uscis :)

I agree with the above. Send package now and start the process, because it takes many many months. In the mean time, walk the beat and try to find a co-sponsor (or even two). That's where I'm at right now too, and I've already passed the NVC stage. Finding a co-sponsor takes just as long as the I-129F processing time it seems.... and I'm right there with you on absolutely not wanting (or not able) to find one, but requiring one either way.
