Hi guys,

 

I have some quires regarding CR-1 Spouse Visa can you please give me some suggestions.

 

1-  my wife is US citizen and we lives together in UAE can she still apply CR-1 Spouse Petition.

2- As she is a house wife and never had any job her mom want to sponsor but she does not have 3 years tax returns she recently got a job from 4 months ago and she is earning $17,500 also she has $70,000 cash in her account her house hold members are 3 (husband, son and her) can she still sponsor us as a co sponsor or do we need some one else for co sponsor.

1. Yes. She just need to show proof of re-establishing domicile in the US.

 

2. Your wife will still fill out the I-864 and then your MIL fills out another I-864. Your MIL have a household size of four when you include the intended immigrant. That means she needs a salary of $30,750 to be the joint sponsor or if she wants to supplement her income with assets, she needs five times the difference. So in your case, the MIL need at least $66,250 in assets plus some change for good measure. So yes, sounds like she can but please be aware that assets are not always accepted. She needs to prove that the assets have been in her possession for at least a year.

Embassy Stage


Dec 16th 2015 - Medical exam


Dec 21st 2015 - Interview


Dec 21st 2015 - 221(g) issued at interview for updated forms


Jan 13th 2016 - Mailed our reply to the 221(g) to the US Embassy, received and CEAC updated the next morning


Jan 20th 2016 - Embassy require more in-depth info on asset for i-864


Feb 1st 2016 - Sent more in-depth info on assets as requested. Received the next morning


Feb 16th 2016 - Visa has been issued :dancing: :dancing: :dancing: :dancing: :dancing:



In the US


April 5th 2016 - POE Newark. No questions asked.


April 14th 2016 - SSN received


May 10th 2016 - First day at my new job :dancing:


May 27th 2016 - Green Card received


June 7th 2016 - Got my Texas driver's license

Basically she has this cash assets from past 2 years and she has all that proofs from her bank statements.

 

Joint sponsor can be any one from the US citizen like i have my friends there who can sponsor us because they have good salary and everything.

If you have a better qualified joint sponsor, with a plausible reason for acting as sponsor, go that direction instead of the MIL.

If her MOM Yearly Salary is more than  $31,000...It should be fine i guess

Since the post you quoted, clearly states the MOM's salary as only $17,500 your post only adds to the clutter. ;)

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Nothing wrong with that, in any way, but please realize it becomes a handicap in proper interpretation of circumstances.  When circumstances are misunderstood, it's easy to muddy the waters with unhelpful or even harmful advice.  It's also easier for YOU to be misunderstood.  Please be careful to avoid adding to the clutter.  There may not always be somebody around to correct you.
