Hello I am in the process of adjustment status, I was already taken the traces, but unfortunately my husband died, now I do not know what to do to continue the process someone help me please😭😭

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Consulate Received : July 30,2014 Transfer to right embassy complete.

Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I do not know how to proceed that's why I gave you the attorney's info so you can ask for a consultation on what to do.
He will tell you exactly step by step what to do. You don't need to retain him and can do this yourself but you need to know
the details involved so I suggest you pay for a consultation over the phone with him and ask your questions.

I am sorry for your loss.

 

Per 8 CFR 204.2(i), your pending I-130 is automatically converted to an I-360. If you instead entered on a K-1 and are adjusting on that basis (so you didn't file an I-130) then you are considered to be the beneficiary of an approved I-360 and can continue with your AoS on that basis.

 

You should make an Infopass at your local office taking (i) all of your NoAs (I-130 and/or I-485) and (ii) a certified copy of your husband's death certificate. USCIS will then take the appropriate action on your case so that your I-485 can proceed.

 

A widow/er is exempt from needing to file an I-864 affidavit of support; you would instead file an I-864W ("waiver") indicating this.
