My EAD I-765 receive date that was concurrently filed with a I-485 was Feb 27th. I had a RFIE for my I-485 which I understand turned my time back to 0. Its been 132 days since I filed and tomorrow marks the 100th day of the RFIE requested documents receive date by USCIS. So far I filed three service requests which either gave me the answer that I am still within current processing times or that I will receive an update within the 90 days of the RFIE date (which I am beyond now too so what a lie that was...). I was not able to expedite although I have a job offer because my husband is my sponsor and signed the Affdavit of Support that he can support me during AOS etc. 

I've contacted my congressman but so far without luck. 

My question is: Is this normal??????? I've seen people who filed before me that still don't have an EAD as well, yes I understand that, but they all submitted their RFIE response a lot later then me and are sometime around day 70 (I checked hundreds of cases in the USCIS tracker app). Other than that everyone who filed months after me get their EADs. I am at loss for words and don't what I can do. Is there anything I can do what I haven't thought of so far?

My wife is on day 80 since reception date. She also has a job waiting for her, just needs to get her EAD

 

Every time I have to deal with a federal government agency it just pisses my off more and more. $2000 in fees for them to push paper around a desk......

2016/09/09 - I-129f mailed

2016/09/12 - Delivered to Lewisville TX

2016/09/12 - NOA1 Date according to Website

2016/09/15 - NOA1 by email, check cashed. Routed to CSC

2016/09/16 - NOA1 Hard copy 797 sent out (was out of country when arrived)

2016/10/13 - NOA2 via the website

2016/10/17 - NOA2 hard-copy received

2016/11/03 - NVC Received

2016/11/04 - NVC Assigned case number (called in and got)

2016/11/07 - Left NVC for consulate in Kyiv

2016/11/10 - Case ready at embassy in Kyiv

2016/11/18 - Medical in Kyiv

2016/11/21 - Medical results received in Kyiv

2016/12/05 - Interview (Approved in about 3 mins!)

2016/12/07 - Status showing as "Issued" on CEAC website

2016/12/09 - Passport with VISA delievered to Fiancee's flat

2017/01/12 - POE @ Washington-Dulles

Oh but 80 days isn't even that long yet... try over 130 days 🙄 You should hear something very soon though. You can put in a service request as well.

I feel your frustration. Shouldn't take 80 days, let alone 130. 

 

Calling the USCIS has been absolutely worthless. We had an RFE on our first attempt and called in because the RFE said we need to include documentation that was included in the package. They had no idea why it was sent back, and keep nothing on file for RFE's.....

I understand your frustration, when it comes to USCIS there operations isn't like first come first serve bases. Sometimes you have to understand they have tons of applications that they have to deal with. I am not making a case on their behalf  even my own AOS has been at Case Schedule for Interview since August, 2016, nothing has happened and I have followed all the steps listed by you. 

Did you try speaking with a Tier 2 officer? EAD are generally handled by the NBC and shouldn't take this long to get a card.

You can apply for expedited even if your husband can support you, using your job as a reason to request for the expedited EAD

Hey, 

yes I've spoken to a tier 2 officer twice about my EAD. THe first time I was told that I can not expedite because I don't have a joint sponsor. By signing the Affdavit of Support my husband vouched for me to be able to support me. I was told that I am not allowed to expedite with a pending job offer because I don't have any grounds to do so. There's been other people with the same problem as me with their partner as the main sponsor. Since I can not show financial hardship there is no way for me to expedite my work authorization.  So that was a bummer.

Today when I called about it again the lady didn't deny nor agree when I said I want to expedite based on financial loss since I can not expedite based on a job offer. She said that I will be contacted having to show proof of that. Don't know how I will do that but I feel like having to wait for 135 days gives me enough proof of financial loss. 

I see people from May getting their EADs so this is just driving me nuts. It's almost like something is wrong with my case or they lost it.

It sure can drive someone nuts, it is frustrating and not having a clear cut solution to the problem is even harder.

Maybe sending your job offer and date it was offered might constitute a reasonable financial loss. I am not sure.

Yes I will try everything I can. Really hoped that after the third service request that was completed on Friday I would be approved. Oh well...
