AP was filed after AOS/EAD package

Hi all,

 

My lawyer didn't advise me to file for the AP with my AOS package (I did file for an EAD which I'm still waiting for, currently on day 91 since the Receipt Date). I have a wedding to go to in September, in Cyprus, so I filed for the AP exactly one month after the original package.

 

Is it possible to call USCIS and ask them to create an EAD/AP combo card, when the time comes for that decision? I don't want to add any more delays to my EAD, since I have a job offer pending on this EAD coming (I don't think I can expedite, since I'm currently working on an L1 visa).

Timeline

L1 visa is dual intent visa. So if you leave the country without AP, your AOS will not be jeopardized. When you return to US, you can enter on your L1 visa again provided that your L1 visa is still valid in passport and you are working for same employer. I hope this helps:)

it is almost 100% I will not be working for the same employer when I leave. Which is why I filed for the AP.

I wouldn't risk leaving without the AP. You can try to contact them and see if it processed along with the EAD.

Well in that case, you will have to wait until your AP gets approved.

I'm worried that expediting because of my brother's wedding, wont be that good of a reason >< Fingers crossed.

You can ask your senator office to look into your situation. Maybe they can help you out.
