Hello i just filed a vawa (i360) through my attorney. I would like to know what my chances are of having it approved. I included evidence of the abuse that dates back to 2006 when i was pregnant with our first child and he hit me for the first time aggravated battery on a pregnant woman is the charge on the police report. they wanted to put him in prison and at the time i refused to testify.Sometimes looking back i hate myself because he should have been convicted and because i was weak i never wanted to testify against him hence why so many police reports but no convicted. i was so terrified on so many levels.  i stayed with this man for ten years and endured this abuse. Had two children who endured the abuse right by my side.  We have multiple police reports, hospital reports, photos of my injuries. I am very scared that even with all my evidence i will be denied because I've been reading many stories of ppl online who ended up being denied and t hey don't have any idea why. please help i keep wondering if there was any different type of evidence me and my attorney might have missed  but we included everything as far as the abuse is concerned. there were multiple stances of physical abuse he even was arrested for domestic violence in one occasion he abused me on so many levels.  he also forced me to work as an exotic dancer to support his drug habit. i included that in my testimony  along with affidavits from friends and family. even his own grandma wrote a statement in my behalf. But I've read on here affidavits from family members don't weight that much. please someone hep me.

i posted this on a different thread with no luck. i hope i have better luck here.

i just filed vawa through my attorney this month. My evidence submitted included pictures of my injuries, 3 police reports one of them dates back to 2006 when he abused me for the first time when i was pregnant with our first child. 2 hospital reports within the last 3years. there is also one domestic violence arrest. But no convictions he was never convicted because i never wanted to go forward with prosecuting him i always ended up going back to him. There are also statements from his best friends wife who is also a friend of mine and witnessed the abuse i suffered. also his own stepmother and grandmother wrote statements on my behalf as they were the ones that took me to the hospital last time i had to go. 

And of course my own statement, which now after everything has been submitted i am sitting here going over every little detail and i feel as if my own statement wasn't strong enough and also i feel that i should've had more people write statements but the problem is i hid the abuse form everybody but my attorney says that with the evidence i have we should be good. I'm so worried

Can anyone that has any experience with this please give me your opinion? should i write a second statement and supplement that to what already has been sent in? am i even allowed to do that?

Hello I can tell you my own experience so far I sent my I-360 self petition with Priority mail to Vermont, they received by May 22nd 2017, 10 days later on June 2nd I received a letter from USCIS "Receipt Notice". and last June 22nd, another letter from USCIS "Establishement of Prima Facie Evidence". with that letter I went to the DMV and got my temporary Driver License, they will mail me the original in the next 2 weeks.

You must have an answer after 30-45 days they received the package.

Thank u so much for answering. and congrats on getting that prima facie notice. As far as evidence goes did you submit a lot of evidence for your case?  i feel like even though i have some serious evidence of abuse it still feels like it may not be enough.

In may case I visited 4 attorneys before I decided to go on my own, all of them have told me to send few proofs of bonafide marriage like a couple of bank statements, few bills, 2 affidavis and a short testimony of myself one of them told me please do not write more than 3 pages so we do not overwhelm them with so much evidence and few pictures.

I finally did my own package and put as much evidence I found, I used a thick 4" binder, I included all the same evidence I mailed the first time when I applied for I-130,shipping labels from online purchases with my name and my spouse name, invoices under my name or my spouse name, all the bank statements for the last 3 years, pictures as collage like 15 pages. My own testimony with all details from how I met my spouse how the relationship was developed and how the problems began, it took me 10 full pages wrote on World on Arial 11pt. I did not have any police report or court order, just 3 affidavits with testimonies of spouse aggression, pictures of injuries done by my spouse to me, receipts from visits to my psychologist, and pictures of the meds I am taking for depression and letter from my therapist.

It looks like you have a strong case, looks like you should get a "Establishment of prima facie" letter soon.

Wait 10 days counting on the day you sent the package and call your attorney to see if they have receive any "Receipt Notice" and after that 20 more days to see if they receive any other notice like "Establishment of prima facie" or "RFE".

In my personal opinion if you receive any RFE....do it yourself, I figure that the lawyers are trying to a light work so they can charge more money to people later to reply to a RFE.

Again thanks for responding! I am worried that my attorney did not ask me to send in pictures or any financial records as proof of bona fide marriage. But I'm wondering if that could be because we do have 2 children together the oldest is 10yo. IN any case feel like i should gather those records and have them in hand just in case i do need them. it can't hurt.  My package was sent in on the first of this month i know i just got started but. Im praying to receive my prima facie!!  i will start calling my lawyer regarding my notices soon.

It seems you submitted enough proof ob abuse, if USCIS needs more proof of a bonafide marriage they will issue an RFE and you will have time enough to gather more documents .

 

I advise you to attend therapy for your own sake and your children as well. When children witness and/or suffer abuse the chance of them growing up dysfunction is very high.
