You've been only married 4 months. It does not matter how long you've been together. Have you even filed for AOS and got your EAD o green card? I think you are not allowed to AOS in he US but need to get an IR-1/CR-1 visa and go you your country for the interview.

 

Scars is not enough evidence for WAVA. You should ask your wife if you could both go to therapy or just talk to her. Plus, if you don't have your paperwork in place you cannot WAVA.

 

He will not have his case scrutinized just because he is here without status,  VAWA petitioners have some exceptions.

Scars can be accepted as a proof of abuse if he is showing his face in the pictures and he should gather affidavits from family and friends stating about the abuse.It's advised to attend 5/7 therapy sessions and get a psychological evaluation done.

 

Do not advise a survivor of domestic violence to talk to his/her abuser!!!! A survivor of domestic violence should cut all contact with his/her abuser immediately, he/she should seek a safe place to stay and he/she should never disclose the locations with the abuser.

Is it usual for a victim without a SSN to be turned away from a shelter?

Not at all.The person can contact the National Coalition Against Domestic Violence in her/his State to report about it.

I am asking because it seems odd that if a person was living in an abusive relationship and then got married and the abuse continued why would there be a benefit of vawa granted? the level of abuse did not increase after marriage but was at what the person was used to. 

 

you would also need proof of abuse. police reports hospital records and such. filing reports now will not mean much they would of needed to be filed during the relationship.

Uscis will not consider the abuse that occurred before the marriage.

sandraj is there any way you could help me file vawa? I dont have money for an attorney. Its kinda hard to get more than a minimum wage job since i dont have legal status. Could you at least guide me with applying for fee waivers??

I was meaning more that he knew what the relationship/abuse was like already and still agreed to merry but then he could no longer take it and hold it ago him and say he should have known what he was getting into.

I think you are looking it logically and I would agree with you but VAWA is not logical.
