No, he cannot AOS because he came when he was a child. He has to file an IR-1 and go to the consulate in his country when his interview is up. He also needs the waivers pre-approved before his interview. That is why I said it was a complicated case. I don't know how the waivers can get approved if he is not married.

OK. Here I found that VAWA grants exceptions to those who are unlawfully in the US:

So it would be a possibility. But OP needs strong evidence. It is not a "she said/he said" question.

I have never filed a report. I dont want her to go to jail. I also havent told anyone. I feel ashamed as i am a man and im being abused. I also think my father abusing makes me think at the end of the day that i deserve this. I always come back to those thoughts. I also think i am depressed as suicidal thoughts have crossed my mind. Being illegal is not easy.

You should seek help. Doing counseling with your wife might help. She has been with you for a long time.

 

Do not mix your feeling towards your father and towards your wife. They are different people. And nobody deserves being abused.

Im in a small town in california. They do background checks since kids are there is what im guessing. I mean in the shelter. Also i dont think i even trust the police here. I was stopped one time for walking at night. I did not have an id and he asked me for my immigration status. I was young so i told him the truth he said get your legal or we will deport you. So im going to try to head to los angeles.
