Hi good people of VJ my name is Katherine my husband has submitted is AOS by 3rd of April and he has his fingerprint  done on the 5th of MAY.  Meanwhile  on the 20th of April the immigration send us a mail  that they need need an RFE which we run  around and gathered all the documents they ask for and we send it to them on the 30th of MAY and they received the RFE by 6th of June. And when we check his status online it says we have receive your RFE we will mail you our decision or if we need anything from you we will let you know that is what is still there up till today nothing has change. Please  good people of VJ this is getting frustrated my husband has  not  done anything over 10 months now and his acting crazy.  What can we do, or when was the assumption time that we can hear from immigration. Please I really need your advice on this. Thanks you all.

For the AOS it can take a year before you hear something it all depends on if he will have a interview or not and sole how backlogged the local office is if he do get an interview. Texas is really bad.

 

Did he not apply for the EAD/AP along with the AOS package? That takes about 3-4 months to receive so if he did then hopefully he will get that in not so long and will be able to work.

Was the RFE for the AOS or for the EAD or AP?  Assuming it was not for the EAD or AP, hopefully he will be getting those soon as it seems to be taking a bit longer than 90 days lately for those to be processed.

You should have the EAD/AP either at the end of this month or next month. You can try to expedite the EAD if you have a job offer in writing
from a potential future employer (pending EAD approval).

Sept. 21 Interview, 2 hour interview, we were separated and asked about 50 questions each for an hour each. IO was firm but professional, some smiles.
Several service requests made, contacted Senator and Ombudsman. Background checks still pending.
July 21, 2017 HOME VISIT.  Went well. Topic thread in AOS forum.
Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS
AOS APPROVED Oct. 4, 2017 * Green card in hand Oct 13, 2017 !!!!!

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

Most people get it for their AOS and it ends up affecting their EAD as well. 

My receive date is 02/27. 130 days of waiting, 95 days since they received my RFIE response.

The RFE Is for the AOS I guess of for both i don't really know because is Affidavit of Support. they said my income is not enough so we look for joint sponsor.

The RFE then to affect the whole application, since it will be reviewed by the office before sending it to various processing center. His EAD should be arriving anytime soon, Did you sign up for email and text alert on the USCIS?. I know how frustrating it is for a man not to be working, just encourage him to stay focus. It will come.

God is your strength....Just prepare pounded yam and egusi soup for him,:D

Haha very funny I will try and do that,  guys please another thing just came to mind now is it possible for me to take him to SSN office since we have his application pending with Uscis maybe he can obtain his SSN since he came to the state with k1 fiance visa. I know we were suppose to have obtain that 2 weeks after his arrival but we didn't know anything like before. His 1-94 only remain 1month to expire that we went to SSN office and a guy that attend to us is the one that told us about his eligible to work and to get SSN. But unfortunately when he submitt his application they said it will take 1month before he can get it, and the lady that spoke to us again  when we went back after one month  said his 1-94 has expired that they can only issue it if he has a pending application with Uscis. Please guys I still need all of you based on your experience can we do that now that his application is with the Uscis, Please guys dont be tired of me my husband is really fausrated  reply ASAP.

Yes you can try that, there is no harm in trying. Since he has a pending case with USCIS. He applied before the expiration of his I-94?. I would suggest you take a trip to the SSA and explained that you had an application before the expiration. And also go with all documents, his stamped entry passport too.

I don't understand what the problem is with him getting a SSN, did you read the guide ? See link below.
He filled out the form with an unexpired I-94 so he should have received the SSN card in the mail after applying for it.
If she said only with a pending AOS application then why did you not take in the AOS NOA1 to as proof that it is pending ?

Thank you guys I really appreciate all of your contribution may God help us all.  My husband call immigration today and they told him they just received his application yesterday I believe the local USCIS  i guess.they said that if he did not hear from them by August 6th that he can call then. I pray they send his EAD before then. GOOD LUCK TO YOU ALL.

Good luck to you too, I would suggest he keep calling them after two weeks interval, just to keep up with his case.
