I owe some debt for credit cards + mortgage.

My k1 visa was just approved, I currently make about 34,000 / year so I'm well above the 125% poverty.

My question is,

I included the debts I own from my Mortgage, my car and my motorcycle, and my credit cards.

Given that I actually only barely make ends meet every month (because I'm actually paying significantly above what i owe on the credit cards)
Is there a chance that we can be disqualified because they might decide I don't make enough to take care of my fiance?

I notice other topics on this, but all the other topics claim they don't ask for my debt, yet theyŗe asking for it right here.

My real estate value I just grabbed off of Zillow, because I'm not sure what its really worth. 
I included my credit card balances, and my vehicle balances along with 8.b. because I assume I'm supposed to.

This has me really worried after all the work we've put into this and then I run into this.

Also, another question


I changed jobs recently, so my taxes from last year will reflect a previous job.
My current job pays more, although both of those.

On the section asking about my income, I put how much I make at my current job for 40 hours a week.
This probably won't be 100% accurate, because all I did was multiply how much I make by 40 x 4 x 12 to get how much I make in a year.

I think I read something that it's going to request tax documents for last year at some point. Those won't match what I currently make. 
How do I handle this?

So your K1 was approved and you are asking for filing AOS ?
Form I-864 is used as affidavit of support not I-134. Current income is enough, just send evidence (tax transcripts, W2, pay stubs, employer letter).
I am not understanding why you are still worried about the I-134 when you have your K1 visa so I assume you are filing AOS.

Biometrics : June 1, 2015 letter received for appointment June 8, 2015, successful walk-in June 1, 2015

RFE : June 12, 2015 for income not meeting guideline. Income does ( ! ) exceed guideline.

RFE response : June 26, 2015 returned with a boat load full of financial evidence.

UPDATE: July 5, 2015 updated on all 3 cases, RFE received June 30, 2015.

Service request : Aug 12, 2015, letter received that it will be processed within 90 days from receipt of RFE.

UPDATE: Aug 24, 2015, EAD card being produced/ordered. ( 102 days from AOS receipt day and 55 days from RFE response received.) Thank you Jesus !

Emails : Aug 24, 2015, EAD approved, EAD card ordered.

Waiting to skip ROC and get 10 yr GC due to over 2 year while pending AOS

First K1 denied after 16 month of AP. Refiled. We are a couple since 2009. Not a sprint but a matter of endurance.

I assume by "k1 approved" you mean you got your NOA2.

 

As far as I've read here in the past, #8b is for "real estate debt"... Not to include all debts like your vehicles, student loans, and so forth. It's under the "Real Estate" section, and  your motorcycle is not real estate.

 

Your home value IS an estimate. What you would sell your home for today.

Basically the reason they put these here is to do a simple math of [value] - [debt] = asset.

 

I've heard of people making the minimum requirement just by having a value - debt of equal to the 125% requirement.

 

Interestingly though, you can include your vehicles (additonal vehicles when you have more than one) under the "value of my other personal property", and they don't care about the debt incurred in obtaining that property... just the value you would sell it at today.

 

HOWEVER, with all of that said, you only need to include those assets if you absolutely needed them to be considered to meet the requirement (and would then need to show proof, such as a bank letter or home appraisal).

Otherwise leave them blank (or they will be ignored anyway).

 

I'm not expert though, so hopefully someone else here can confirm this. I'm going based on info I searched here (which you can do as well).

If I read the pdf on that page, it requests that I do an affidavit of support form I-134

Am I wrong? I would sincerely be happy if I'm wrong as I think the 864 form is easier.  I'm not sure, Honestly I'm exhaustingly confused by this mountain legal jargon and unclear steps on how to proceed...

I received this email yesterday (And probably got a physical letter in the mail somewhere that I haven't gotten yet)

OK, now it is clear. You have not had your interview and your K1 has NOT been approved yet but the I-129 petition has been approved.
Yes, you do need the I-134 before the interview and later when you are in the US and married you file AOS with the I-864.
If you meet or exceed the poverty guidelines then you can leave out all the asset and debt questions, you go only by your income.

So I can completely skip 8.a. through 9.d. ?

Another thing we're unclear on. After she completes the ds160 and we have to log in and pay the Visa fee. (which I don't know if I can log in and pay for her, or if I need to transfer her the money so she can pay it)

Does she file under a non-immigrant visa?
Asked a friend who went through this and she's adamant that it's a non-immigrant visa. Not to say I don't trust her, I do. She's gotten us this far, however I'm just confused on it, because this page, where we go to pay her visa fees, seems to imply that she'd be filing for an immigrant visa:  http://www.ustraveldocs.com/lv/lv-steps.asp

Which our mutual friend said wouldn't be the case as it would be nearly impossible for anyone to be approved to be with their spouses if she were to choose the immigrant visa on this page.

Thanks so much for all the help so far, this has gotten so frustrating for us.

It has been a long time since we went through it and I rarely comment in these issues about how to pay for a K1 visa
and how to book an interview, things have changed since we went through it.
Looking at this page though the K1 is listed under immigrant visas, even though it is a non immigrant visa it also referred as an immigrant visa
at a certain stage because it has immigrant intent. I would go with immigrant.
