Waiver 6C1

Hello, I am wondering if anyone knows about or has had any experience doing this waiver. My mother was refused her immigrant visa and is eligible to do a waiver. Does anyone know the approval rate and how to prove your case?

Back story helps, why was she refused assuming she needs a waiver does she have a qualifying relative to file one?

 

6C suggests misrepresentation.

My mother overstayed in usa, and has a ban until the 10 years is over which is next year. But because she came back and applied for an F1 visa and got approved the consular thinks she lied and didnt tell the office that she overstayed. This is untrue because I at the time was with my mother and we told the officer everything, we were very lucky he gave it to us although it was a mistake. So they want her to do the waiver. Im just wondering how can we prove this and what exactly is the waiver? And what about the approval rating?

Hopefully she kept a copy of her F1 application as amongst other things she would have declared here previous US visits.

 

Misrep is a life time bar and she would need a spouse or parent to file a waiver, success rate is pretty good.

im not sure we have the application its been 7 years, maybe it can be online ? Is there any other way?

The officer said she can file for herself under the 6cI waiver.

Hopefully she has a hard copy, you obviously need to show that she disclosed all the information about her previous US visits.
