K1 visa with a AP so we can have a wedding in PI later

Thanks for taking the time to read this.

Michelle and I are thinking of using the K1 visa. I will petition in July 07 for her and then we will be married on or about the summer of 08. We like the 90 day window for marriage that the K1 offers and it seems to be the best fit for us. I still would like to hold a big wedding for her and her family in the PI later so I am considering the option of a AP (Advance Parole) when we fill for her AOS.

Now I know that we could use the K3 and be done with it but the K1 will allow us to have time together alone in Guam and since there is about a 6 month wait on a AP that will give us time to save and plan for a nice wedding in the PI.

My question is will we have a problem getting an AP since the real reason we want it is to get married in the PI later? I know that the spirit of the AP is for emergency uses and I don't want to jeopardize any good standing relationship I have with Immigrations. What do you think of my situation and would you just use the K3 even though it may not be as nice and as well plan wedding using the K1 with an AP?

My feeling is that our big wedding in the PI is a very special day and this is an attempt to give Michelle the best wedding possible. I don’t know if I should risk it or if there is even a risk of using an AP for this purpose.

Has anyone done this and how did it workout for you two?

01-20-2008 Received visa via Delbros (Found out the delay had to do with my request for expidte, info still needed to be input at the NVC level so held it up for a few weeks)

I'm not so sure AP is strictly emergency use. At least I don't remember that being a stipulation when applying for AP. We just put down "just in case he wants to visit home or if family needs him" and that was sufficient. He got AP. I would assume as long as you fulfill the obligations of the K1 - if you go that route - then using AP to go home for a planned wedding would be ok. Remember though, this is just my opinion. Check the guides section about AP...the instructions and guidelines for AP are there. :)

OK, I think I've got it:

Advance Parole (AP) is for someone coming from another country to the US for emergency reason(s). Reentry Permits (RP) allow a Permanent or Conditional Resident to travel out of the country and back.

When I posted the topic I believe I was getting some of the info mixed up between the AP and RP. I know you can understand that I have read more documents and info than I read text books my first year of college and it all starts to jell together after awhile.

Advance Parole is also for someone (K3s are an exception) who is in the USA pending adjustment of status and wants to leave the USA and return again without causing their adjustment application to be considered abandoned. On return they are not admitted, they are paroled in.

You shouldn't have any problems using the AP to travel back to the RP. Claudeth and I also elected to do the K1 and then later return to the Philippines to have a traditional wedding there so her family can attend. Good luck to you!

You shouldn't have any problems using the AP to travel back to the RP. Claudeth and I also elected to do the K1 and then later return to the Philippines to have a traditional wedding there so her family can attend. Good luck to you!
