Hi guys,

 

My wife and I moved to the US a little bit over a month ago, but have lived in Spain for the past 2 and a half years (2014, 2015 and 2016). She worked in the US in 2014 and 2015 in summer, but not in 2016 in the US at all. She uses TurboTax to file her taxes. When we applied for the visa she used 2014 and 2015 records, but now for the AOS she has to use 2016, but as she hasn't worked TurboTax won't allow her to file anything. I know she still has to prove that she doesn't owe anything, so she needs a tax return from 2016. Any of you guys have been in the same situation or knows what to do in this case?

 

P.S.: We're using a joint sponsor for i-864

Have you tried other tax software? You might have to get help with this. Though you are not mandated to file taxes if you ain't working, but for the case of the USCIS, you have to show something. Try using google to research on how to file taxes for no employment.

Wish I could help more, maybe the Vet on VJ will contribute to this post, they are more helpful with their knowledge.. Everything will be fine.

Did she work abroad?  if so, she was still required to file taxes with the IRS, and may need to do a paper return.

If she did not work at all, then a couple of sentences explaining she did not work at all, had no income even abroad and thus was not required to file taxes will do.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

That make sense, do you think that is enough just explaining for USCIS? ...I read somewhere that it is still best to file taxes even if there is no income.

The paper filing will be the best way to go about it.

I seen it work many times for spousal visas, but it is rather unusual for AOS.  Should still work though, especially with a joint sponsor.

Thank you for all the answers! There's one thing I didn't mention before because I didn't think it was important, but now I think it is important. My wife was in Spain with a student visa, and she was paid 700€ a month as a scholarship, she didn't have any other job, income or something like that, so (at least what I've been told) technically she didn't have to pay taxes either in Spain or the US, what do you guys think about this?
