Hey, 

 

My fiancé forgot to send his birth certificate will we defiantly get an RFE? As anyone else forgot this, I read somewhere that they asked the beneficiary to bring it it to the interview? 

 

Also does anyone know what the current waiting time for an RFE?

Only the petitioner sends in their birth certificate if you've done this your fine ☺

I think I already told you this before, but unless he sent his passport copy, you'll get a RFE for sure, since US citizenship for the petitioner has to be proved.

 

And there's been a bunch of people getting the NOA2 just a week or two after USCIS got their response to the RFE, for that kind of straight things, so not too bad :)

If the American sent in their complete unexpired Passport copy then no need for Birth Certificate as a BC was required to get the Passport to begin with.

You can get an RFE any time after you send in the I-129F could be 30 days could be 120 days.

Once you do get an RFE and respond then normally takes 2-5 weeks for NOA 2.

The petitioner has to prove their US Citizenship, it can be done by one of the following, Birth Certificate, Complete Passport Copy, or US Citizenship certificate. If the petitioner sent either the passport copy or us citizen certificate copy then birth certificate would not be needed. As far birth certificate for beneficiary its not needed until after NOA2
