K3 Approved at CSC - Now What?

Hi VJ,

Thanks to everyone who has helped us get through this stage! All your help and advice kept us on the right track and clear-cut documentation. Looks like it paid off as we got our approval from the CSC in 28 days after NOA1! :dance:

Over the past couple weeks I've gathered documentation, namely,

- bank letters

- employment letter

- tax transcripts + my 2006 tax return copy

- filled up the I-134 and will get it notarized this week by USCIS

My wife has put in the applications necessary for getting the police clearance certificate and medical records in India.

Now that the case will go to the NVC, are there any more forms I should be filling/signing and sending to my spouse or NVC with the copies of the K3 and CR1 application?

I just read on another thread that the DS230 Part 1 needs to be sent to NVC for CR1. Does this apply to K3 as well? http://www.visajourney.com/forums/index.ph...mp;#entry839060

The K3 process is quite a different process than the CR-1. With the K3, your wife will get a multientry, nonimmigrant visa without work privileges. After she arrives in the USA, you will probably apply to adjust her status to permanent residency.

(There is another path to permanent residency, but it appears more complicated and, probably, more expensive, that involves getting the CR-1 issued after she enters on the K3. If you go to that path, your wife would need to return to India for the CR-1 interview. Not many people take that route.)

Your case will go to NVC and should be there just a few days before being forwarded on to Mumbai. The NVC essentially gets approved petitions and sits on them until they come up in a priority queue set by the immigration laws. Since the beneficiary is your wife, and since the approved petition is a I-129F, she has immediate priority and NVC will send the documents on to Mumbai. (For the CR-1, you provide documents to NVC that are similar in function to those you will provide USCIS when you apply to adjust her status for permanent residency.)

Details of documentation requirements for K3 interviews vary from diplomatic post to post. In Moscow, for instance, they want to see 3 years of tax returns, not one. Some posts require a support statement different from the I-134. The number I-824 comes to mind, but I haven't checked -- so I could be wrong. I am writing this before Sunday morning coffee -- always a risk :)

For the K3 interview, because the financial documents that you are already gathering, it can be a good idea to make sure that your wife has other evidence thatt yours is a continuing, bona fide relationship. Have you been able to see her since you filed? Photos would be great. Copies of selected emails would be very good. You may black out personal sections of email that you don't want the govt to read. Do you send her parcels? Maybe copies of tracking documents and shipping receipts would be good. (My wife will be getting plenty of those.) Wedding photos might be a good idea, if you have them. You probably get the idea.

can you please tell me what sort of bank letters are you gathering? what is it supposed to be about?

Also, how are you getting your documents notarized? mean are you sending it in to be notarized or going in person?

I am in Nashville, TN and not sure where will go to get my documents notarized. Also, what documents are you getting notarized? i know i need to get i-134 and i-824 notarized but do i need to get my bank letters or anything else notarized?

6-13-2007: called DOS and NVC to make sure mumbai had the case. we never got the packet 3 perhaps no one was at home!?!?

6-14-2007: Wife overnights packet 3 which was downloaded from the mumbai consulate site, filled it out, and sent it in along with other documents

6-15-2007: packet 3 delivered to mumbai consulate

Thanks novotul. This clarifies a lot. So basically all I need to do now is ship her all the documentation and proof I've been gathering. We had an elaborate wedding, so there is no dearth of photographs :).. tons of emails, parcel receipts, my flight boarding passes, etc. for proof so I think we're good.

I'm also thinking of writing a really racy email :devil: to her and providing that among the proofs just to have some fun :)... I wonder if those officers would turn red with embarassment! lol!

I basically got a letter from my bank stating in total how much money I have with them combining all my accounts. I have such a letter from December 2006 and another that I got in March 2007 which will show a consistent balance. You might also want to have some recent bank statements.

You need to get the I-134 notarized. Looks like the closest local USCIS office to you would be Memphis. I'm not sure if you could use a general state notary (such as the people authorized at Kinko's) to do this for you... can someone else chime in on this?

The bank will be giving you the letter on their letter head with original signatures and bank stamp. No need to get this notarized, but instead ask them to provide you with 2-3 original copies.
