Hello 

 

My Father Apply for - f4 brothers and sisters of u.s.- for his Sister from 2003 and this Days He Get NVC case Number and she widow and have 3 children 

2 Unmarried born in 1989 and another One born 1984 and one Married 1987 

and after complete NVC DS-260 for My sister only one son - born 1989 and 28 years old - show to complete DS-260 and Pay fees for him 

when i apply for f4 in 2003 all her children was Younger than 21 years Old 

 

 

i want ask what about the other children

probably all her children will be denied

 

they are all too old for cspa

 

for children to be derivatives they have to be unmarried and under 21, for CSPA to cover them, to freeze their age as minors, the closer they are to 21, the greater the chance they can come with parents. the others are left behind, out of the petition

Look, CSPA age of any child who is over 21 is calculated at the time of interview. Age of the boy/girl at interview date is reduced by the number of days  (Normally years in case of f4) they took to approve the case. If, after this calculation the age of child is below 21 he is eligible, otherwise not.Hope this helps you...

To calculate the persons immigration age you take the date the petition was filed and calculate how many days until it was approved ( NOT when it became current )   and take that many days off the persons real age.

This will not be over quickly. You will not enjoy this.

Obviously the posts are confusing but OP seems to say that CSPA covered the youngest?
