Parents want to move to US with IR2 Visa still in process HELP

Hi everyone, I'm not well-versed in everything to do with citizenship so I hope you can help.

 

For a bit of background, I'm Canadian born. My family and I lived in Florida for 10 years illegally and then we moved back to Canada in 2010.

My mother is a USC. My sister and I filed for IR2 visas in 2016, which is still in process.

My application was started right before I turned 21. I'm 22 now. My parents told us recently that they want to move back to Florida in October even though we haven't gotten our visas yet.

When I told my mother I don't want to go back illegally, she said we can apply for a work visa. I've tried to look up information but I found everything confusing. 

I don't want to go back without being a citizen, but I feel like I don't have a choice as I'm financially dependent on my parents. I know my visa application will still take at least 6 months to be completed as it's currently in the NVC stage.

 

Any advice on what my sister and I can do at this point?

You can't apply for a work visa. The US employer apply for you if you qualify. And imo it will take longer than 6 months.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

No he's not. They haven't applied for him, or my 28 year old brother either. The only one that's a USC is my mother.

My parents are very irresponsible if you haven't noticed...

Yeah I kind of guessed that. Well their plan just isn't working. Have you sat them down and told them how immigration is working in the US?

Ok, thank you. That's what I thought as well. I know it'll take at least a year to get our visas.

 

Do we have any other options, such as applying for residency or adjustment of status since my mother is sponsoring us?

Yes she can apply for you all but it will take a year to get the visas to move down here.

Yes, we had quite a discussion about it. That's why I wanted to ask if I had any other options other than waiting for my visa to finish processing but it seems I don't have any.

That's what I thought as well. Thank you for your help regardless.

You can apply for a student visa but that will cost a lot of money to study that way you can move sown with your mom she can still apply for you in the mean time. But your dad can't just move down with her. She has to apply for a spouse visa for him. 

 

Was she a USC when you were born? If so why didn't she apply for citizenship for you?

She wasn't a USC when I was born. My parents were born in Guyana and immigrated to Canada. We all moved to the US when I was a child.

 

I've thought about applying for a student visa, but like you said it will be expensive and I wanted to work first before attending school there hence why I asked about a work visa.

No one in my family is banned. I'm not sure exactly how it works, but my family and I have all been to and from the US since we moved a number of times. If we were banned, I don't think they would be allowed back into the country.
