Packet 3 Before NOA2

Timeline

April Filer here. Waiting on the NOA2. Could be coming anytime this month or August.

 

Anyway, I was just in the Philippines a couple weeks ago with my fiance, and I had given her documents for her future interview with the USEM.

I gave her the I-134 form and supporting documents which I filled out before leaving the US, and also documents of proof of genuine relationship (same documents I used for the Visa Application, and also a couple new pictures) and while I was in the Philippines, we obtained an NBI Clearance and CENOMAR.

 

So now, the only thing we are waiting on is the NOA2 before filling out the DS160, registering for an interview, and St. Lukes appointment. I just wanted to shave off some time for prep time before the Interview.

 

I just wanted to ask, is it okay if we have the I134 and its supporting documents, CENOMAR, NBI Certificate, that is needed for the interview, dated in June which is obviously month(s) before we get our NOA2?

 

Or do we have to gather those documents needed prior to the interview specifically AFTER we have received the NOA2.

Timeline

Certain items have expiration dates. Obviously getting things together a head of time can be helpful and save time; but you should be okay with everything. NBI mainly has a 1 year time frame I believe it was.

 

The I-134 though should be relatively up to date as in within 30 days of the interview, same with pay stubs and such given to show income. Those, mainly the I-134 with original wet signature, I just sent FedEx before hand.. Takes 2-3 days and relatively decent price.

The I-134 was signed and dated 06/06/2017. Her interview will probably be sometime between mid august to end of august. The I-134 I had given her won't be valid then?

 

Thanks for letting me know, just curious, where did you get that source from?

It will still be "valid", generally trying to keep things within 30 days I myself find best; but long as you can supply more up to date pay stubs and such should be okay.

Thanks. If you dont mind me asking, from your signature, I do see almost a 2.5 month gap between NOA2 and visa interview. I do find that as an average for other filers as well. Why did it take so long? and also, do you think there were other ways to reduce that time as well?

Of course can shorten that time frame. I travel internationally for work sometimes, I was in Kazakhstan at that point when NVC sent our letter with case number. I never bothered calling them. So we lost a week or two there. Than had to reschedule interview because medical was so close together. Also last second rush on CFO completion. Had to wait for new passport prior to that because his old one was expiring... Just multiple little things. We weren't in a huge huge rush as he was also waiting to leave his job and gave them two weeks notice and all.

ahh wow thats a lot of things that could have had a shortened time frame but glad everything worked out for the both of you.

 

Just curious, what do you mean by CFO Completion? Does every K1 filer have to go through that?

Yes, every citizen of the Philippines must complete this. They won't be allowed through immigrations at the airport otherwise.

Having completed the I-134 and leaving the supporting documents as well with her was a great move on your part. Don't be surprised if it's not asked for by the CO as it hasn't really been asked for, for about 2 years now. But, they leave the "door open" to ask for it and if you don't have it you will receive a 221(g) which is a delay till you submit the required document in answer to the 221(g).  Could add an extra 2-3 weeks to you get your final approval.

 

It will take 7 - 10 days business for NVC to receive your file from USCIS after you receive the NOA2, then another 2 - 5 business days for NVC to get your file in there system and get the MNL # from USEM.  Call 7:00am eastern time for shorter wait times K1's are not tracked through the AVR, ever. They are processed like an immigrant visa, but they are NOT immigrant visas, so they fall into a completely different class of their own. Therefore you need an operator. To get there:

 

1-603-334-0700 or 603-334-0888. Operator assistance is available Monday through Friday from 7:00 AM to 12:00 AM (Eastern Time)

 

Press 5 for non-immigrant visa K-1 visa.

 

NVC CONTACT INFORMATION:

E-mail: NVCInquiry@state.gov    I highly recommend you email NVC for the MNL #, even if you call and get it, this will give you a correspondence from NVC with the MNL # for future reference.  The email request for your MNL # is also a great way to track when your file is forwarded to USEM as NVC will not reply to the email until that time. 

 

At the time of the interview the NBI must not be over 6 months old so keep and eye on the calendar and if you need a new NBI then secure one just before the interview. You don't need a new NBI if it is less then 6 months old.  If you are in the 5th month at the time of the interview your good, if you are in the 6th month better get a new one or again, 221(g) will be issued.

 

The only other item that you should check is all the documents are the dates and names spelled correctly. Especially, the Birth Certificate. It's better to find out now when you can be doing something to make changes then later when it will only delay you.

 

Also, check the passport to ensure there is plenty of time to use it. Also, is her name spelled correctly on the passport.  Remember everything will need to match to avoid any problems.

 

Other than what I have stated above you can sit back and relax. Because once you have the MNL# it's balls to the walls.

A completed I-134 Affidavit of Support Form may be useful to the consular officer to evaluate your petitioner’s ability to be financially responsible for you. You may also be asked to submit your petitioner’s most recent U.S. Federal income tax return (Form 1040) and wage statements (Form W-2). Employment letters stating salaries and bank statements may be included to substantiate the I-134. Download Form I-134 at http://www.uscis.gov/portal/site/uscis.

I gave her the I-134 form and supporting documents which I filled out before leaving the US, and also documents of proof of genuine relationship (same documents I used for the Visa Application, and also a couple new pictures) and while I was in the Philippines, we obtained an NBI Clearance and CENOMAR.

 

So now, the only thing we are waiting on is the NOA2 before filling out the DS160, registering for an interview, and St. Lukes appointment. I just wanted to shave off some time for prep time before the Interview.

 

I just wanted to ask, is it okay if we have the I134 and its supporting documents, CENOMAR, NBI Certificate, that is needed for the interview, dated in June which is obviously month(s) before we get our NOA2?

 

Or do we have to gather those documents needed prior to the interview specifically AFTER we have received the NOA2.

The I-134 won't be an issue as the embassy requests that and a copy of your most recent tax return... so all is good until next spring ;)   And like noted, since 2014 many times it is not asked for by the CO.

 

NBI and CENOMAR are the documents that the embassy is picky about for being "too old", they don't like either document to be older than 6 months at the time of interview.  You should not have issue with those if you interview within that time frame.

 

Your case file arriving from USICS to NVC isn't going near fast as noted though.  Many times that has been taking most of 30 days.  About two weeks after you get your NOA2 you can start contacting NVC, but don't be surprised if it takes a few weeks before receiving the MNL#.

According to the information I posted in answer to asaeljuthro, you will need the I-134 or face a delay in your visa processing until you submit to the CO. Your fiance can email you everything so you will have it with you in the event that it is asked for. P3 is the Embassy Letter and a link to it was provided to you in my earlier post.

Yes support evidence (most recent tax return and W2, plus original I-134) is listed in the instructions letter from the embassy.

Don't need bank statements or employer letter unless the USC is a new employee.
