Hello everyone, I'm working in the United States as a valid H1 visa holder and my spouse as a dependent, the problem is my employer didn't file my wife's extension last year even though I did submit required docs and now I got to know about that when I tried to switch my current employer to a different one(new employer). They said when I submitted the I-795 and all other required documents that she might be in the US as an illegal immigrant and I'm afraid USCIS might depart her to native. Later when I asked my current employer about this he said we can proceed with an explanation letter to FIX this.

 

Suggest me any ideas how to proceed from here in a safe way.

 It will be hard for anyone to provide advice without looking at the paperwork, dates, etc. 

 

What is the expiration date on her visa? What does her i-94 say? She might be alright. 

 

Maybe get a lawyer. Your employer sounds very shady. A letter won't fix anything, if there is a problem. 

 

If your employer hired a lawyer to file your paperwork, try to talk to that person.
