Sue USCIS in District Court both for adjustment of Status and Money

So perhaps, after all, not a false decision. Just one not in his favor. You can't sue USCIS on that basis.

So apparently he has also filed for asylum?

 

He also said in a private message that he is not married. So it looks to me like this is a divorced man living and working out status in the United States (basing that on the asylum thing) and thinks he can get a citizenship.

I'm afraid someone misinformed OP about sue immigration and granted citizenship 😔

Sounds like fake marriage followed by frivolous asylum case.

 

Wonder what basis he has been working on, sounds like any legal basis would have disappeared a long time ago.

35 years later?     Yeah, let us know how that turns out.

 

Have you thought about just refilling again IF your still married to the same wife from 35 years ago,   That may be your best solution to this whole mess.

Cause USCIS is not going to give you a green card due to them not adjusting your case from way back then.

I truly doubt USCIS  has your case from back then. Maybe keeps them 7 years, as I do required by law  with work from US Customs, FDA, other government agencies.

 

 

Suing USCIS is a losing battle, and I don't see any level headed lawyer accepting your case, much less then a Judge  entertaining the thought of this lawsuit with a decision.

NOID issued May 17th 2019

June 5th,2019   USCIS received my response on the  NOID// Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

I admire the OP's "creativity" .  However, I think he is climbing a very steep uphill battle considering the current scrutiny of "out of status" residents.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
