Previous K1 withdrawn less than 2 years ago

Hello all,

 

I have previously filed a K1 petition and due to (shall we say) circumstances withdrew the petition after NOA2 and NVC processing but before it reached the embassy.

Fast forward about 1 year and I am about to propose to a wonderful woman and would like to begin the K1/K2 process.

I have emails from me to the USCIS & Manila Consulate asking for the previous K1 to be withdrawn and an email (5 months later) from the USCIS stating it was a closed/cancelled case.

So the question:

Do I need to include anything in my petition concerning this previous K1?  

I apologize if there is an old thread that addresses this, I was unable to locate it.

You probably can include a statement outlining what happened to the last petition if you want to. If I'm not mistaken, the I-129F does ask if the petitioner has ever filed an immigration petition for someone else. You can file this new petition but do expect some scrutiny considering the last one was just about a year ago.

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

Refer to Part 1, Items 43-47. That should address your concern. Make sure that your fiancee knows about the previous petition because she might be asked by the CO at the K-1 interview.

Thank you Kul.  Yes, I was aware of the questions on the I-129 you referred too.  Just wasn't sure if I should include documentation explaining the circumstances surrounding the termination of the previous K1.  

My fiancée is aware the previous K1.  We have discussed it at length.
