Denied Tourist visa, is this a problem.

My fiance ws denied a tourist visa in FEB 07. Will there be a problem with fiance visa interview. Some of our documents for fiance visa were dated in Jan 07. Is this a problem?? I figured she can say she just wanted to visit USA before she moved here and the reason the fiance dates are dated in Jan is because I heard having a Fiance visa and asking for a tourist visa is taboo!!!! Does this sound believable???? Help!!!!

Met Dec. 4 2006

1st visit to Russia - Jan. 23-30.

Engaged Jan. 24

CSC recieved and pending - NOA1 March 1

Touched- March 9 - recieved NOA1 hard copy in mail.

2nd visit - March 12 -27

Touched - May 23 (pleeeeeeeeeeeease)

APPROVED MAY 22 (On 5/25 I did the RFE trick and the CSC said it was approved 5/22. The dufus at USCIS was completely positive they were only working on Nov. 2006 petitions)

May 30th- Petition leaves CSC for NVC.

3rd visit - May 31 - August 31 ( If all goes well she will come home with me!!!)

Left NVC June 11th (I called everyday since 5/30 and they never recieved it??? Then on 6/13 I called and it was not only recieved but already sent to the embassy 6/11?? 

INTERVIEW 8/22

July 3rd-Recieved Packet

8/22 Interview was a sucess!!!

8/31 We arrive at JFK. Problem free entry.

10/26 Married!

1/15/08 Sent I-485

2/26 NOA

3/21 Biometrics Appointment

3/29 Received EAD Card

Well we went through UK embassy. And exactly one year ago he had applied for a tourist visa and was denied. We applied for K1 in Augst of 06 and interviewed March 26 and he was approved for fiance visa. So I have heard different things but just be very honest as to why u did that etc..

Tell the truth.

The visas are judged using completely different criteria. The B visas don't effect the K visas.

But deciding not to share information like a denial - aka: lying - that IS a problem. On the K visa forms (DS-156, etc), she will be asked if she's ever been denied. CHECK THE YES BOX! You'll be fine, so long as you tell the truth. Period.

I-129F/K1

1-12-07 mailed to CSC

1-22-07 DHS cashes the I-129F check

1-23-07 NOA1 Notice Date

1-26-07 NOA1 arrives in the post

4-25-07 Touched!

4-26-07 Touched again!

5-3-07 NOA2!!! Two approval emails received at 11:36am

5-10-07 Arrived at NVC/5-14-07 Left NVC - London-bound!

5-17-07??? London receives?

5-20-07 Packet 3 mailed

5-26-07 Packet 3 received

5-29-07 Packet 3 returned, few days later than planned due to bank holiday weekend

6-06-07 Medical in London (called to schedule on May 29)

6-11-07 "Medical in file" at Embassy

6-14-07 Resent packet 3 to Embassy after hearing nothing about first try

6-22-07 DOS says "applicant now eligible for interview," ie: they enter p3 into their system

6-25-07 DOS says interview date is August 21

6-28-07 Help from our congressional representative gives us new interview date: July 6

7-06-07 Interview at 9:00 am at the London Embassy - Approved.

7-16-07 Visa delivered after 'security checks' completed

I-129F approved in 111 days; Interview 174 days from filing

Just be honest - doesn't seem to be a problem (imho).

11/2004 - Met in Brazil

09/2006 - Apply for K1

03/2007 - K1 approved

04/2007 - Apply for AOS & EAD

07/2007 - EAD approved

01/2008 - Conditional Residency approved

11/2009 - Apply to remove conditions

02/2010 - Permanent Residency approved

11/2010 - Apply for Citizenship

03/2011 - Citizenship approved

07/2011 - Moved back to Brazil

Don't know - you don't mention why he was denied.

Depends on the voice and body language of the person making the statement.

Forget about what 'sounds good' and concentrate on what's accurate.
