Fiance Visa Criminal Expungement

I noticed in the fiance visa instructions (https://www.uscis.gov/i-129f) that only "specified crimes" need to be revealed even if they were expunged or sealed in Parts 3 Items 1 through 3c.  However, crimes that are not listed as specific crimes, the instructions ask for the petitioner to list the crimes committed but does not mention that it has to be revealed if they were sealed or expunged (Part 4a).  Does this mean non specific crimes, like a misdimeanor, if expunged, does not have to be revealed and petitioner can mark no to this part? I got it expunged through ARD process. This was and is my first time misdimeanor.

You won't need to provide court documents since it's not one of the listed crimes for 1-3c, however you still need to answer 4.a. and 4.b. and list it there.

 

It doesn't explicitly say to do so even if it was sealed or expunged, but it doesn't say not to do so. The questions refer to if you were ever arrested, cited, charged, indicted, convicted, fined, or imprisoned. Even if the case was sealed or expunged, if you met that criteria then you need to declare it. It shouldn't impact the process...it just needs to be declared. They will still run a background check.
