same-sex couples US-Germany?

Hi all!

Since the "Ehe für alle" decision last week, we are wondering if this will allow us to expedite our case, as we became Lebenspartner-shafted in 2008.

Anyone interested in following events with me?

It seems that the law won't take effect until July 9th, but I also heard rumors of an appeal.

Anyone out there know more?

Well, if we could show that we were actually married in 2008, that would demonstrate that we did not marry for the Green Card, and we might not have to wait as long, we might avoid an interview, and my wife might get her citizenship more quickly. We've been treated like second-class citizens by both governments, we've lost a lot of time and money having to apply as "fiancées" when we were already spouses.

I am not trolling. I don't understand if your AOS was approved, there is nothing to expedite. AOS is when you are already in he US and you got your green card.

 

Are you applying for a spousal visa or a fiance visa? If that is the case, your information is wrong.

 

Even if you had a ceremony in 2008 (not marriage by German standards at the time), you can present it as evidence. 

 

I don't know the case of Germany, but in general laws don't change what has happened in the past. You probably need to marry again in Germany under the new law. This was the case in other countries that passed same-sex marriage laws. Your previous union will still be an union and it will not transform itself to a marriage.

Can you explain a bit more about your case? Are you currently in Germany? 

If you are in Germany and have applied for K1 then you should know there is no expedite for K1 AOS based on proving no fraud and who gets an interview as a K1 is random. 

The process to get to the US as spouses is roughly a year. The K1 is faster getting to the US but costs more from start until Green Card. The time to Green Card is many times similar. As far as becoming citizen this will also be similar times since the time to Green Card is similar and that is what the N400 application is based on.

Not true. The fact that you married in 2008 has nothing to do with demonstrating that it was not for green card. It means nothing, there's just no such law or experience. It only shows that your marriage is older than 2 years. The same goes for "we might not have to wait as long, we might avoid an interview, and my wife might get her citizenship more quickly". I think you will wait as others and have your interview as well because you will be considering as a ordinary couple. Even if you got married 9 years ago, this fact does not let you avoid all these steps, this is how immigration works. It is only your fault that "we've lost a lot of time and money having to apply as "fiancées" when we were already spouses". You decided to apply as "fiancées". No one pushed you to do so.

If the same-sex marriage isn't recognized in that country, they had no other option.
