Hey everyone I've been following this thread for awhile and I think its great and it help a lot of people who are wondering about Some questions regarding their process!

well I have a question that I've been wondering about and can't find answers anywhere!

so I left my old job and I'm trying to find another one! But of course my green card is expired! And the extension letter is about to expire!

but! I have a full driver license! And it's still valid for another 3 years and a half!

so my question now, when I get a new job as you all know we have to fill form I-9 with the new employer!

Can I use my driver license as an identity verification?

will my employer request to see the green card ? Or he will be satisfied with the DL?

That's a qualified yes. If you have a current driver's license AND an unrestricted Social Security Number card. If your SSN card has the words:

  • VALID FOR WORK ONLY WITH INS AUTHORIZATION [or]
  • VALID FOR WORK ONLY WITH DHS AUTHORIZATION

then you have to use your Green Card (or a passport stamp which you can get in an InfoPass appointment with your local USCIS office.

Hi  there, 

 

I am interested to see what people say about this, as I have had 3 different jobs since coming to the US, and I have not had to ever show my GC. I've always just provided my DL and my SS 🤔 So I'm now not sure if that's normal, or if I'm going to be missing paperwork, like this I-9 that you've mentioned? 😯 I can't recall ever completing one of those, unless it was slipped in with my other employment paperwork and I just completed it without knowing that was what it was.

No - DL is not acceptable.  You need to have a Green Card, Birth Certificate, or US Passport to prove your status.  You are out of luck here.  I still am working but my GC is expired but I am approved and I kn ow I can't leave my job for another job until I have either my US passport or US Certificate in my hands.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Read the i-9 instructions, it seems you misinterpreted something.

Nope - 

 

They WILL ask you for your Green Card and if it is expired - they can't accept you.  Even though you are considered legally resident but you can't prove your status.  Right now I am stuck here in the US because I am waiting for my oath to come in.  My GC expired a few weeks ago and I was supposed to go to Canada with my kids but now my kids are with my parents and I'm stuck here.  I am not going to risk myself by going out of the country and not able to get back in on my expired GC.  I am not going risk to leave my job for another job in the middle of this.

Also, even if they do ask for your green card (although why would they, if you have the appropriate ID required on the I-9) and the only GC you have is expired (but you are in the process of getting either your 10 yr green card or your naturalization, you can get the prospective employer to search you on E-Verify, which will show you as having current legal status, and you legally cannot be denied employment on that basis.

 

A lot of employers don't know about this, so we have to educate them.

 

You're right, though, you need to have proof of your status to travel. Either an unexpired green card, an expired green card with the accompanying NOA letter that extends the expiry date of your card (as in the case of Removal of Conditions) or an I-551 stamp in your unexpired passport. (Incidentally, and sorry it's too late to help you, you probably could have gone to your local USCIS office and gotten the stamp if you'd wanted to travel while you await your oath. I'm surprised they didn't provide you with an extension letter.)

You would have filled it in as part of your employment paperwork, probably alongside the tax documents. It's a one sheet form, probably just slid right by!

After reading instructions of I-9, employer cannot ask for specif documents to verify employment eligibility. The prospect employee can present documents either from List A, or documents from list B AND C but not only B or only C. Documents in list B and C include but not limit to a valid Driver's License and Social Security Card.  In case of doubt, take the time to read the instructions to correct me if I am wrong.

Not really - in DC area they ASK for those documents period.  So i guess it depends on employers.

 

Even if they check with UCIS - but expired items is not something that they like.

 

So I am not schooled - just depends on employers and location.
