Denied Tourist visa, is this a problem.

My fiance ws denied a tourist visa in FEB 07. Will there be a problem with fiance visa interview. Some of our documents for fiance visa were dated in Jan 07. Is this a problem?? I figured she can say she just wanted to visit USA before she moved here and the reason the fiance dates are dated in Jan is because I heard having a Fiance visa and asking for a tourist visa is taboo!!!! Does this sound believable???? Help!!!!

There is no problem with a denied B2. What was the answer in the application

( for tourist visa ) where it asked if there is a fiance in the US ? If the answer was truthfully yes then you have nothing to worry about , if you said no then that is misrepresentation.

It is not fraud to apply for a B2 during a K1 but almost impossible for most

countries to be granted one.

They will cross check all answers with the applications.

If she answered no fiance on the tourist appl. and yes during the interview as to the date of engagemnet she will have a problem.

The truth is vital on all applications. When did you engage and how will you proof that to the interviewer ?

There should be no issue, I came to Korea to get my SO a tourist Visa, however the interviewer basically said sorry but you will have to wait unti lyou get your K1 Visa...I asked several questions concerning it, including if the denial for tourist visa will hurt her for the K1, he said no, it actually helps the case as it shows an ongoing relationship, even if it were denied.

The issue is not with will the denied B2 hurt the k1, the issue is was the

FWAguy was referring to whoever told the OP that he would have trouble with the situation because of the application for a tourist visa. Clearly he will have trouble if she outright lied on the B2 application, but if they were not engaged, there should not be any issue.

I wouldn't worry too much. Remember, it takes 2 to be engaged. I had already filled out the I-129F before we were "officially" engaged. There is no legal document that says you are "engaged."

The concern is for B visas being used to circumvent the K-1. (since they are so much faster). It is impossible to prove that you intended to marry with the B visa. Since you were planning just a visit, and that is what she told them, there is no issue.

The purpose of the embassy interview is to detect fraud. That's about it. Wanting to see your fiance is not consistent with fraud.

Don't even worry about it, just make sure that when she goes for the interview, she has her story straight by then.
