Hi guys,

I'm kind of lost and don't really know what to do.. My wife and I  got married in 2015, I received my conditional GC in May 2015.. And filed jointly for the i751 in March 2017.. I  entered the marrige in good faith, but sadly for many reasons things are no longer working out for us... I have decided to live separately from my wife to keep the peace, I am still paying for the mortgage, bills and other expenses that she has out of good will (even though we no longer see eye to eye anymore) 

However she has recently started to  verbally threat and abuse me that she will inform office of dention and removal operations that I have married her only for immigrations benefits. 

 

Can anybody please advise me  on what to do?

And she will be able to proof that how exactly?

aren't you still paying for her livelihood?

 

don't let a bitter woman decide how your emotional stability develops. I'm sure there's alot more happening an maybe you both have fault in things going wrong. But keep track of what you do and what you say. And be safe and cautious.

We hear stories all the time of how USC spouses threaten to inform USCIS and have the foreign spouse deported.  Long and short, foreign spouses coming here on a K1 or CR1 are not things bought at a store that can be discarded when something goes wrong.  My advice is to make sure you have all the evidence you can muster to show you entered the marriage in good faith, then get a good lawyer and start divorce proceedings.

1) Calm down. Very unlikely that she can do anything, even less so if it isn't based on fact.

2 )Stop funding her.

3) Gather joint documents from the time of filing the I-751 until the present, plus originals of everything you filed in your I-751.

4) Get a competent divorce lawyer, as I suspect this will get messy.

5) File for divorce. You may have no choice, as if you get called for interview for a joint petition, and she doesn't attend, you MUST switch to a divorce waiver, or you get denied.

6) Add a divorce waiver to your existing I-751, which removes her from the process entirely from that point onwards.

7) Move on with your life

Maybe also seek advice from a competent immigration lawyer.  I'm sorry to hear this but yes, I've seen posts on VJ such as these before.  Perhaps an admin can point you to where these threads are kept.  Good luck and God bless.

7/22/2023: Both (parents) petitions approved

7/27/2023: Both cases sent to NVC

Just do a google search "ROC divorce waiver visajourney" and you will find several threads of people that have been through similar situations.

We see this scenario on VJ, along with the other scenario with the foreign spouse crying VAWA for an "easier" path to stay after divorce.

 

Make sure you print out statements from joint accounts and joint credit cards. If you're both on the house deed, make sure you have a copy of that too. Then divorce and move on.

 

You haven't filled out your timeline so I don't know what state you're in. Whether or not you're in a community property state will have a big impact on your divorce and the time leading up to it.

Hi, are you from American Samoa? If so, you are considered a "American National" but not an American citizen, I found something that say that if you are an American Samoan, you could apply for citizenship after living here for only 3 months...check it out!

i just wanted to ask if I file for divorce now at this stage what are the chances that I'd be called for an interview?..
